Grantor and Grantee entered into that certain Construction and Maintenance <br />Easement dated as of August 13, 2020, which was recorded with the Hall County <br />Register of Deeds Office on August 26, 2020, as Instrument No. 202006333 (the <br />"Prior Easement") . <br />B. Grantor owns certain real estate located in Grand Island and legally described as <br />Outlot 1, Prairie Commons Second Subdivision, Hall County, Nebraska (the <br />"Grantor Property") . <br />C. Grantor and Grantee desire to amend and restate the Prior Easement pursuant <br />to the terms of this Easement to expand the improvements that may be <br />constructed by Grantee, or its permitted successors and assigns, on the Grantor <br />Property as part of the development of the Prairie Commons Subdivision. <br />NOW THEREFORE, in consideration of the mutual benefits to be derived from <br />the facilities described herein and the further consideration of One and No/ 100 Dollar <br />($1.00), the receipt of which is hereby acknowledged, Grantor does hereby convey to <br />
