Grantee acknowledges and agrees that Grantee's use of the easement area for access to said irrigation well as necessary to irrigate a portion of the crops grown on Tract 1 shall be limited to foot traffic and non - motorized vehicular traffic only and Grantee further agrees to use the easement area in such a manner so that the same remains in substantially the same condition as the same currently exists. 5. Grantors acknowledge that in order for Grantee to provide necessary repairs to said irrigation well, it will be necessary for Grantee to have access to said irrigation well from the south. Therefore, Grantors additionally grant to Grantee and to Grantee's heirs, successors and assigns the right to use the existing driveway and yard area situated on Tract 2 as reasonably necessary for the limited purpose of permitting Grantee and /or Grantee's agents or employees to perform the needed repair to said irrigation well. Grantee shall use his best efforts to inform Grantors in advance of the need to use the driveway and yard area to perform needed repairs to the irrigation well, shall use said driveway and yard area in a careful manner, shall cause said repairs to be completed in a timely manner, shall be responsible to repair any damage caused to said driveway and yard area by virtue of the limited purpose of providing necessary repairs to said irrigation well and shall indemnify and hold the Grantors harmless from any and all claims and demands of whatsoever nature arising by virtue of Grantee's use of the said driveway and yard area. 6. Grantee's right to use the said irrigation well as granted hereinabove and the foregoing easement as granted herein above shall continue until Grantee or Grantee's heirs, successors and assigns elect to abandon the said irrigation well at which time all rights as to the use of the said irrigation well and easement area granted to Grantee shall terminate and this agreement shall thereafter be deemed to be of no further force or effect whatsoever. In the event Grantee or Grantee's heirs, successors and assigns elect to abandon the irrigation well, Grantee or Grantee's heirs, successors and assigns, as the case may be, shall provide written notice to Grantors or to Grantors' heirs, successors and assigns, as the case may be, of Grantee's intent to abandon said irrigation well and the effective date of such abandonment. Furthermore, if Grantee fails to use the said irrigation well for a period of four (4) full consecutive crop years, Grantee shall be deemed to have abandoned said irrigation well and all rights as to the use of said irrigation well and the easement area shall terminate and this agreement shall thereafter be of no further force or effect whatsoever.
