202502568 <br />effects and other articles, tools and equipment of personal, household or yard use or ornament, <br />together with all rights that I may have under insurance policies relating thereto to my spouse. If <br />my spouse fails to survive me, then I leave my tangible personal property in accordance with a <br />memorandum which I intend to leave at my death and which I incorporate herein by reference. If <br />I do not leave such a memorandum, then to my children in equal shares as they shall agree. <br />ARTICLE V <br />Residuary Provisions <br />A. If my spouse survives me, I give, devise and bequeath all of the rest, residue and <br />remainder of my estate, both personal property and real estate, whether now owned by me or <br />hereafter acquired and wheresoever situated, to my spouse, outright and free of trust to have and <br />to hold the same forever. <br />B. If my spouse does not survive me, I give, devise and bequeath all of the rest, residue <br />and remainder of my estate, both personal property and real estate, whether now owned by me or <br />hereafter acquired and wheresoever situated, to my children outright and free of trust, in equal <br />shares, share and share alike, per stirpes. <br />C. No title shall vest in any beneficiary until actual distribution thereof to such <br />beneficiary. No rights of any beneficiary shall be subject to assignment, anticip liabilityufor <br />rt for <br />any indebtedness, or subject to any attachment, order, decree, judgment process of any Y co <br />the purpose of collecting any such indebtedness of any beneficiary. <br />ARTICLE VI <br />Personal Representative <br />I name, nominate and appoint my spouse, to be the Personal Representative of this, my <br />Last Will and Testament. If my spouse does not survive me, or if for any reason it becomes legally <br />necessary for the court to appoint a replacement for my spouse, then I direct that Heath Robert <br />Kruger shall be appointed as successor Personal Representative of this, my Last Will and <br />Testament. <br />I direct that each fiduciary named in this Will shall be permitted to serve without bond, and <br />that if, notwithstanding this direction, any bond be required by any law, rule or order of any court, <br />no surety or sureties be required thereon, and that if, notwithstanding this direction, a surety or <br />sureties be required thereon, only nominal bond shall be required. <br />The Personal Representative shall receive reasonable compensation for their services <br />hereunder, but not in excess of the amount usually charged for like services by corporate fiduciaries <br />in the same geographical area. <br />TPK <br />Page 2 of 5 <br />
