<br />QUITCLAIM DEED
<br />THIS DEED, made this 24i'I- day of N, 202Cby and between the
<br />UNITED STATES OF AMERICA, acting by and through the UNITED STATES
<br />DEPARTMENT OF TRANSPORTATION, FEDERAL HIGHWAY ADMINISTRATION,
<br />hereinafter referred to as the DEPARTMENT, and the STATE OF NEBRASKA, acting by and
<br />through the NEBRASKA GAME & PARKS COMMISSION, hereinafter referred to as the
<br />STATE:
<br />WITNESSETH:
<br />WHEREAS, the Federal Highway Administrator, acting pursuant to delegation of authority
<br />from the Secretary of Transportation, is authorized pursuant to Title 23, United States Code,
<br />Section 107 (72 Stat. 892) to acquire, at the request of a State, any lands or interests in lands
<br />(including within the term "interests in lands", the control of access thereto from adjoining lands)
<br />required by such State for right-of-way or other purposes in connection with any construction,
<br />reconstruction or improvement project of any section of the National System of Interstate and
<br />Defense Highways; and
<br />WHEREAS, the Federal Highway Administrator, at the request of the State, acquired for use
<br />in connection with the I-80/Locust Street Interchange, Project Number STPE-2235(2) — Tract 4 —
<br />South Locust Street in Hall County, Nebraska, certain land and interests in lands in a
<br />condemnation proceeding designated as United States of America v. 101.47 Acres of Land, More
<br />or Less, Situate in Hall County, Nebraska, and the State of Nebraska, acting by and through the
<br />Board of Educational Lands and Funds, Civil No. 4:02CV3057, instituted in the United States
<br />District Court for the District of Nebraska on March 7, 2002.
<br />WHEREAS, on the filing of a Declaration of Taking executed by the Federal Highway
<br />Administration Nebraska Division Administrator and the deposit of his estimate of just
<br />compensation into the Registry of the Court, title to the interest in said lands as set forth and
<br />described in the Declaration of Taking vested in the United States; and
<br />WHEREAS, Title 23, United States Code, Section 107(c) (72 Stat. 893) authorizes the
<br />conveyance of such lands and interests in lands to the State of Nebraska: and
<br />NOW, THEREFORE, the Department, as authorized by law, and upon condition that the
<br />State will accept title to the land and maintain the project constructed thereon, including its
<br />control of access features, as a part of the National System of Interstate and Defense Highways,
<br />in accordance with the statutes and regulations for the administration of Federal -aid for highways
<br />and policies and procedures prescribed by the Federal Highway Administrator, and also, in
<br />accordance with and in compliance with all requirements imposed by or pursuant to 49 C.F.R.
<br />Part 21, pertaining to and effectuating the provisions of Title VI of the Civil Rights Act of 1964,
<br />(78 Stat. 252; 42 U.S.C. 2000d to 2000d-6), does hereby remise, release, quitclaim and convey
<br />unto the State of Nebraska, all of the right, title and interest of the United States in and to said
<br />lands described in Schedule A, attached hereto and made a part hereof, being the same lands and
