This EXTENSION AGREEMENT made and executed this2 1 }day JANUARY. 2004, by <br />and between HOME FEDERAL SAVINGS AND LOAN ASSOCIATION OF GRAND ISLAND, <br />hereinafter referred to as "Lender ", and <br />DANIEL L WELCH AND ANN C WELCH, HUSBAND AND WIFE <br />hereinafter referred to as "Borrower ". <br />WITNESSETH: <br />WHEREAS, borrower has previously executed and delivered unto Lender a certain Note <br />secured by a Deed of Trust/Mortgage upon that real estate described as: <br />A PIECE OR PARCEL OF LAND SITUATED IN THE NORTHEAST QUARTER (NET /4) OF SECTION <br />TWENTY ONE (21). TOWNSHIP ELEVEN (11) NORTH, RANGE NINE (9) WEST OF THE 6TH P.M. <br />HALL COUNTY, NEBRASKA MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING <br />AT A POINT SIXTY (60) FEET DUE NORTH OF THE NORTHEAST CORNER OF LOT ONE (1), OF <br />WILLIAM FRANK ADDITION TO THE CITY OF GRAND ISLAND, NEBRASKA; THENCE RUNING <br />DUE NORTH ON A LINE THIRTY -THREE (33) FEET WEST OF THE CENTER LINE OF SOUTH <br />LOCUST STREET IN SAID CITY FOR A DISTANCE OF ONE HUNDRED (100) FEET; THENCE <br />RUNNING DI TE WEST AT RIGIiT ANGLES WITH SAID LOCUST STREET FOR A DISTANCE OF <br />EIGHTY -FIVE (85) FEET; THENCE RUNNING DUE SOUTH PARALLEL WITH SAID SOUTH LOCUST <br />STREET FOR A DISTANCE OF ONE HUNDRED (100) FEET; THENCE RUNNINF DUE EAST FOR A <br />DISTANCE OF EIGHTY FIVE (85) FEET TO THE PLACE OF BEGINNING, EXCFPTING A CERTAIN <br />TRACT OWNED BY THE CITY OF GRAND ISLAND, STATE OF NEBRASKA AS SHOWN IN <br />RETURN OF APPRAISERS RECORDED IN BOOK 22, PAGE 9 <br />which Deed of Trust/Mortgage was dated JULY 25 1997, and filed for record on JULY 31. 1997 <br />in the office of the HALL, COUNTY REGISTER OF DEED'S OFFICE, HALL COUNTY, <br />NEBRASKA as DOCUMENT # 97- 106138; <br />WHEREAS, such Deed of Trust/Mortgage had a stated maturity date of AUGUST 1. 2007. <br />WHEREAS, Lender and Borrower have mutually agreed to renew and extend the <br />indebtedness secured by such Deed of Trust/Mortgage, <br />NOW, THEREFORE, in consideration of such renewal and extension, the parties hereto give <br />notice in accord with NEB. REV. STAT. SS 76 -239 of the continued effectiveness of the Deed of <br />Trust/Mortgage above described in the following respects: <br />1. MATURITY DATE. The stated maturity of the above- described Deed of Trust/Mortgage <br />is hereby AMENDED TO JANUARY 1 2009 <br />2, CONTINUED EFFECTIVENESS.
