Locust St., Ste. #306, Grand Island, NE 68801 <br />V AMENDMENT TO DECLARATION <br />OF COVENANTS, CONDITIONS AND RESTRICTIONS <br />THIS AMENDMENT is made on the date hereinafter set forth, by Park Garden Homeowners <br />Association, Inc., hereinafter referred to as "Declarant", comprising of the owners of all the <br />following described real estate, to -wit: <br />Lots 1 thru 8 of Park Gardens 2nd Subdivision <br />Lots 1 thru 3 of Park Gardens 3rd Subdivision <br />Lots 1 thru 3 of Park Gardens 4th Subdivision <br />Lots 1 thru 8 of Park Gardens 5th Subdivision <br />All in the City of Grand Island, Hall County, Nebraska. <br />WHEREAS, the undersigned, being a majority of the property owners as defined by the Declaration <br />of Covenants, Conditions and Restrictions as previously filed immediately prior to the date hereof <br />have determined that such Covenants, Conditions and Restrictions should be modified to protect the <br />integrity and functions of the Association; and <br />WHEREAS, at the annual meeting of the Association, held in accordance with the By-laws of said <br />Association, and upon vote of the "Members" of the Association, additional restrictions pertaining <br />to ownership and occupancy were determined; <br />NOW THEREFORE, Park Gardens Home Owner's Association as represented by the signers hereof <br />comprising a majority of the "owners" of the real estate described above as defined by the existing <br />Declaration of Covenants, Conditions and Restrictions hereby amends the definition of "owner" as <br />follows: <br />"Section 2. "Owner" shall mean and refer to the record owner, whether one or more persons <br />or entities, of a fee simple title to any Lot which is a part of the Properties, including contract <br />sellers, but excluding those having such interest merely as security for the performance of <br />an obligation, and which person, whether one or more, or entity as represented by a member, <br />majority stockholder, or beneficiary shall occupy said property as a primary residence." <br />sa � <br />
