202501323 <br />9. Successors and Assigns. This agreement shall run with the land and shall be <br />binding upon and inure to the benefit of the parties hereto, their successors, assigns, heirs, devisees, <br />and legatees. Where the term "Subdivide?' is used in this agreement, the subsequent owners of any <br />lots in the subdivision shall be responsible to perform any of the conditions of this agreement if the <br />Subdivider has not performed such conditions. <br />10. Care and Maintenance. Subdivider acknowledges and understands that at all <br />times during the development process and at all times thereafter the property must be maintained in <br />compliance with City Code including insuring that no grass, weeds, or worthless vegetation <br />accumulates and that the property remains free and clear of any prohibited garbage, waste, rubbish or <br />construction debris except for construction materials as allowed by law.
