2025011 95 <br />C. Unit owners shall not be prohibited from carrying other insurance for his or her <br />own benefit. Insurance coverage on furnishings and appliances and other items of <br />personal property belonging to an owner and any loss of use or other coverages <br />available to unit owner shall be the sole and direct responsibility of the unit <br />owners thereof, and the Executive Board and the Association shall have no <br />responsibility thereto. <br />D. Each unit owner shall, at all times and when requested, provide the Executive <br />Board with a Certificate of Insurance providing that the insurance required by the <br />unit owner pursuant to Section 2 herein is in full force and effect and providing <br />that Brentwood By The Lake Condominium Association, Inc., a Nebraska non- <br />profit corporation, is an additional insured and that said insurer issuing the policy <br />shall not cancel or refuse to renew it until sixty (60) days after notice of the <br />proposed cancellation or non -renewal has been mailed to the President of the <br />Board. <br />E. In the event that any unit owner fails or refuses to obtain or pay any insurance <br />premium when due and said Association receives a notice of cancellation in <br />reference to the coverage required by Section 2 herein, the premium shall be paid <br />by the Executive Board of the Association with association funds and shall <br />become a lien on the interest of the unit owner in his or her unit and the Directors <br />may record such lien in the office of the Register of Deeds of Hall County, <br />Nebraska, where upon said lien shall be privileged over and prior to all liens and <br />encumbrances except assessments, assessment liens and charges for taxes past due <br />and unpaid on a unit except prior duly recorded mortgage and lien instruments. <br />Said amount shall immediately bear interest at the highest legal rate from the <br />payment of said amount by the Association until paid by the unit owner. The <br />Executive Board shall have the right and duty to attempt to recover such common <br />charges together with interest thereon and the expenses of proceeding, including <br />attorney's fees, in an action to recover the same brought against such unit owner <br />or by foreclosure of the lien on such unit granted by Section 76-874 of the <br />Nebraska Condominium Act. The Executive Board, acting on behalf of all unit <br />owners, shall have power to purchase such unit at the foreclosure sale and to <br />acquire, hold, lease, mortgage, vote the votes appurtenant to convey or otherwise <br />deal with the same. A suit to recover a money judgment for unpaid premiums <br />shall be maintainable without foreclosing or waiving the lien securing same. <br />IT IS HEREBY CERTIFIED that a special meeting was called for the purpose of <br />amending these By -Laws whereby at least two-thirds or more of the units of the Association <br />voted in the affirmative and such Amendment has the approval of more than fifty percent (50%) <br />in number of the first mortgagees of record in all of the units upon the date of said adoption of <br />said Amendment.
