<br />WHEREAS, FIRST STATE BANK of Gothenburg, Dawson County, Nebraska, as Trustee under the Deed of
<br />Trust dated, March 31, 2003, executed by Richard L. Hartman and Patricia A. Hartman, husband and wife as Trustor,
<br />in which First State Bank is named as Beneficiary, and the undersigned as Trustee, and recorded in the office of the
<br />Register of Deeds of Hall county, in Instruments No. 200304338 and Instrument No. 200312901 has received from the
<br />Beneficiary thereunder, a written request to reconvey, a portion of the real property described therein:
<br />NOW THEREFORE, in accordance with such request and the provisions of such deed of trust the
<br />undersigned, as trustee, does hereby reconvey, without warranty, to the person s entitled thereto, namely Richard L.
<br />Hartman and Patricia A. Hartman, husband and wife.
<br />A portion of the estate now held by it thereunder, towit:
<br />A tract of land comprising a part of the Southwest Quarter of the Southeast Quarter (SW IASE1 /4) of Section Thirty
<br />Two (32), Township Eleven (11) North, Range Nine (9) West of the 6h P.M., Hall County, Nebraska, and more
<br />particularly described as follows:
<br />Beginning at a point on the south line of said Southwest Quarter of the Southeast Quarter (SW 1 /4SE1 /4), said point
<br />being Five and Eighty Six hundredths (5.86) feet east of the southwest corner of said Southwest Quarter of the
<br />Southeast Quarter (SW 1 /4SE1 /4), said point also being on the easterly right of way line of the St. Joseph Branch of the
<br />Union Pacific Railroad Company, said easterly railroad right of way line being Fifty (50.0) feet east of (measured
<br />perpendicular to) the centerline of the existing railroad track, thence running easterly, along and upon the south line of
<br />said Southwest Quarter of the Southeast Quarter (SW 1 /4SE1 /4), a distance of Seven hundred Twenty Nine and Two
<br />Hundredths (729.02) feet; thence deflecting left 91 degrees 44' 49" and running northerly, paralel with said easterly
<br />railroad right of way line, a distance of Sic Hundred Three and Sevety Seven and Hundredths (603.77) feet; thence
<br />deflecting left 88 degrees 15' 11" and running westerly, parallel with the south line of said Southwest Quarter of the
<br />Southeast Quarter (SW I ASE 1 /4), a distance of Seven Hundredths Twenty Nine and Two Hundredths (729.02) feet to a
<br />point on said easterly railroad right of say line, said point being Fifty (50.0) feet east of (measured perpendicular to) the
<br />centerline of said existing railroad track; thence deflecting left 91 degrees 44' 49" and running southelry, along and
<br />upon said easterly railroad right of way line, a distance of Six Hundred Three and Seventy Seven Hundredths (603.77)
<br />feet to the point of beginning.
<br />The Trustee retains all the property described in the Deed of Trust excepting only that portion
<br />described above.
<br />In witness whereof, the undersigned has executed this deed of reconveyance at Gothenburg, Nebraska, on
<br />January 13, 2004.
