202501071 <br />FSA-2300-7 NE (12-27-23) Page 2 of 2 <br />It is specifically understood and agreed this instrument shall not be construed as a subordination of the Prior <br />Indebtedness, defined to be a Note or Debt instrument dated (13) whose principal <br />balance does not exceed the Maximum Lien Amount(s) of (14): $ 508,280.00 and <br />including extensions, renewals or modifications thereof. The Lienholder subordinates any and all future lending <br />secured by the above -described security instruments including any principal in excess of the Maximum Lien <br />Amount (except for Permitted Advances); future advances except Permitted Advances (defined to mean those <br />made for taxes, insurance or payment on other prior liens, or those for which the Lienholder obtains prior written <br />consent of the Government); and any additional lending (regardless of whether now existing or made in the <br />future), however defined, including other notes, lending, credit, advances, and extensions of new principal <br />(including through a modification), secured under a cross-collateralization, future advance, or similar clause. <br />This subordination covers: (1) the amount actually loaned by the Government to the Borrower (principal and <br />accrued interest) for the foregoing purposes, (2) future advances for taxes, insurance, payment of prior liens, and <br />protection of the security, and (3) the amount actually advanced for foreclosure costs made by the Government. <br />IN WITNESS WHEREOF, the lienholder has executed this subordination agreement by signing on <br />(15) Feb Dm doa9 <br />(Date) <br />(16) Name of Lienh der's Representative <br />STATE OF NEBRASKA <br />(17) Title r <br />17.
