202501042 <br />b. Boat Docks. Docks shall not exceed twenty five feet (25') from shoreline. Sea <br />walls, Docks and Lifts require approval from the Architectural Committee. No boat <br />storage garage shall be built on the lake or the beach. No more than two (2) boats <br />are permitted per Lot. <br />c. Boating Rules. Nebraska Boating Rules and Regulations apply to usage of the <br />Lake. Boat drivers must comply with Nebraska licensing, certification and safety <br />course requirements. All boat travel is counter -clockwise. Boats cannot exceed <br />twenty two feet (22') in length. Each Lake Lot Owner shall be limited to two (2) <br />boats. All boats shall be registered with the Association. Each Lake Lot Owner <br />will be given a sticker for each registered boat, and this sticker must be prominently <br />displayed on the left bow side of the boat. Nonresidents and Non Lake Lot Owners <br />do not have the right of boat usage on the Lake. <br />d. Fishing Rules. Fishing on the Lake is only on a "catch and release" basis. <br />Owners and invited guests of Owners are permitted to fish. All guests must be <br />accompanied by an Owner to fish — NO EXCEPTIONS. <br />e. Retaining Walls. A retaining wall shall be constructed by each Owner prior <br />to occupancy and must divide the back yard from the beach area and must be at <br />least twenty feet (20') away from the shoreline as set forth in the Developer's site <br />plan. Each Owner is required to maintain the beach between the retaining wall and <br />the Lake in a weed free and attractive manner. The wall maintained by the Owner. <br />The design, location, materials and height of the divider walls shall be approved by <br />the Architectural Committee. No construction or landscaping shall be allowed on <br />the beach area within approximately twenty feet (20') of the shore line. It is the <br />intent of the Association, Inc. to have a continuous sand beach around the lake. <br />15. Waiver of Exemption Right. NO OWNER MAY PROTEST PROPERTY TAX <br />VALUATIONS FOR ANY LOT REQUESTING A VALUATION LESS THAN ANY <br />MINIMUM VALUATION AS SET FORTH IN ANY EXISTING OR FUTURE <br />REDEVELOPMENT CONTRACT FOR ANY OUTSTANDING TAX INCREMENT <br />FINANCING PROJECT, NOR CLAIM, OR IN ANY MANNER UTILIZE, THE NEBRASKA <br />HOMESTEAD EXEMPTION (OR ANY OTHER EXEMPTION UNDER NEBRASKA OR <br />FEDERAL LAW) TO EXCLUDE ANY LOT FROM THE OBLIGATION TO PAY ANY AD <br />VALOREM TAXES OR REDUCE TAXES LEVIED UPON A LOT FOR SO LONG AS ANY <br />PORTION OF SUCH AD VALOREM TAXES ATTRIBUTABLE TO THAT LOT ARE <br />ALLOCATED INTO A SPECIAL FUND OF THE COMMUNITY REDEVELOPMENT <br />7 <br />
