202500752 <br />as evidenced by said Borrower's Promissory Note dated March 7, 2024, payable <br />according to the terms thereof. <br />This security instrument secures to Lender each and all of the following: (a) the debt <br />evidenced by the above -mentioned Promissory Note, with interest (if any), together <br />with all extensions, renewals, modifications, and/or substitutions, (b) all future <br />advances from Lender to Borrower or other future obligations of Borrower to Lender <br />under any promissory note, contract, guaranty, or other evidence of debt existing now <br />or executed after this Deed of Trust, whether or not this Deed of Trust is specifically <br />referenced to in the evidence of debt, (c) all other obligations of Borrower to Lender, <br />which may now exist or may later arise, to the extent not prohibited by law, (d) all <br />additional sums advanced and expenses incurred by Lender for insuring, preserving, <br />or otherwise protecting the property which is the subject of this Deed of Trust and its <br />value, and any other sums advanced and expenses incurred by Lender under the <br />terms of this Deed of Trust including, but not limited to, trustee's fees, attorneys fees, <br />property taxes, and other costs and expenses relating thereto. <br />If more than one person signs this Deed of Trust as Borrower, each Borrower agrees <br />that this Deed of Trust will secure all obligations described above that are incurred <br />by any one or more Borrower, or by any one or more Borrower and others. <br />Borrower covenants that Borrower is lawfully seized of such real estate and has the <br />legal power and lawful authority to convey the same and warrants and will defend <br />title to the real estate against the lawful claims of all persons. <br />BORROWER AND LENDER HEREBY AGREE AS FOLLOWS: <br />1. 2023 NEBRASKA AFFORDABLE HOUSING TRUST FUND GRANT <br />("NAHFT"). Borrower has secured funding from the 2023 Nebraska Affordable <br />Housing Trust Fund Grant (Award Contract Number 23-TRFH-34010). Borrower <br />agrees to remain current and compliant with all obligations, conditions, and <br />responsibilities demanded of Borrower under the NAHTF. <br />2. PAYMENTS. In lieu of monetary payments, Borrower shall remain <br />current with, and in compliance of, the terms of the 2023 NAHTF program. So long <br />as Borrower remains in compliance with the 2023 NAHTF program, no payments <br />shall be required. <br />3. LIENS OR ENCUMBRANCES AGAINST PROPERTY. In no event <br />shall Borrower allow or cause to allow a lien or encumbrance to attach to or to be <br />placed on or against the property without the express written permission of the <br />Lender. In the event that Borrower is in violation or default of this section, Lender <br />shall be entitled to the same remedies as those set forth in Paragraph "4.
