<br /> John H. Bergmeyer, a member of the Nebraska State Bar Association,whose address is 800 Lincoln
<br /> Square, 121 S. 13th Street, P.O. Box 82028, Lincoln, Nebraska 68501-2028, Grantor, as trustee under that
<br /> certain Deed of Trust described below (the "Trust Deed"), for valuable consideration, hereby grants and
<br /> conveys to AMERUS LIFE INSURANCE COMPANY, Grantee,without any covenant or warranty, expressed
<br /> or implied, all of the following desc�ibed real estate(as defined in Nes. REV. Sr,aT. § 76-201):
<br /> Lot 6, except the South 8 feet of the East 60 feet, Block 2, Hann's Second Addition, City of
<br /> Grand Island, Hall County, Nebraska (the"Property").
<br /> This conveyance is made pursuant to the powers conferred on Grantor under that certain Trust Deed
<br /> dated January 17, 1997, executed by Allan R. Hancock and Connie R. Hancock, Husband and Wife, as
<br /> Trustors, in which AmerUs Bank, a Federal Savings Bank("AmerUs"), is named Beneficiary and Trustee, and
<br /> filed for record on January 24, 1997, as Instrument No. 97-100538, in the records of the Register of Deeds
<br /> of Hall County, Nebraska. By executing the Trust Deed, the Trustors named therein granted and conveyed
<br /> to the Trustee named therein, on the trust therein expressed,the Property to secure, among other obligations,
<br /> payment of a promissory note of even date in the original principal amount of$59,400.00 and interest thereon
<br /> in accordance with the terms set forth in said promissory note. Commercial Federal Bank, a Federal Savings
<br /> Bank, as successor by merger to AmerUs, by and through its attorney-in-fact, AmerUs Home Equity, Inc., an
<br /> lowa corporation, transferred and assigned to AMERUS LIFE INSURANCE COMPANY all right, title and
<br /> beneficial interest of AmerUs as beneficiary under the Trust Deed pursuant to that certain Assignment of Deed
<br /> of Trust dated January 11, 1999 and filed for record on January 19, 1999, as Instrument No. 99-100625, in
<br /> the records of the Register of Deeds of Hall County, Nebraska (the "AssignmenY'). AMERUS LIFE
<br /> INSURANCE COMPANY, as the assignee under the Assignment and Beneficiary under the Trust Deed,
<br /> executed that certain Substitution of Trustee, dated January 26, 1999, and recorded in the records of the
<br /> Register of Deeds of Hall County, Nebraska on February 1, 1999, as Instrument No. 99-101107, and thereby
<br /> named Grantor as the Successor Trustee under the Trust Deed. Grantor hereby sets forth the following
<br /> recitals evidencing the compliance with and satisfaction of all requirements and conditions specified in the
<br /> Trust Deed and arising under applicable law to authorize the conveyance of the property contemplated
<br /> hereunder:
<br /> A. The Trustors named in the Trust Deed defaulted on the obligations arising under the Trust
<br /> Deed in the particulars set forth in the Notice of Default described below, and such default
<br /> continued until the time of the sale of the Property.
<br /> B. The Successor Trustee named above executed that certain Notice of Default dated February
<br /> 3, 1999 and filed for record in the records of the Register of Deeds of Hall County, Nebraska
<br /> on February 4, 1999,as Instrument No. 99-101290. Said Notice of Default was executed and
<br /> filed for record in accordance with the requirements set forth in the Trust Deed and in
<br /> accordance with all requirements arising under the Nebraska Trust Deeds Act. Copies of
<br /> said Notice of Default were mailed in the manner and within the time required by the Trust
