2025 00241 <br />southeasterly line of an existing Drainage Easement described in Instrument <br />No. 202200419 recorded in the Hall County, Nebraska Register of Deeds <br />Office, a distance of twenty-three and eighty-five hundredths (23.85) feet; <br />thence southerly and parallel with the easterly right-of-way line of Grove <br />Avenue, a distance of two hundred five and fifty-nine hundredths (205.59) <br />feet to a point on the extension of the southerly line of Northwest Subdivision; <br />thence westerly along the extension of the southerly line of said Northwest <br />Subdivision, a distance of ten (10.0) feet to a point on the easterly right-of- <br />way line of said Grove Avenue; thence northerly along the easterly line of <br />said Grove Avenue, a distance of two hundred nine and one hundredth <br />(209.01) feet to a point on the southeasterly line of said existing Drainage <br />Easement; thence northeasterly, along the southeasterly line of said existing <br />Drainage Easement, a distance of thirty-one and eighty-four hundredths <br />(31.84) feet to a point on the southerly right-of-way line of said Capital <br />Avenue; thence easterly along the southerly line of said Capital Avenue, a <br />distance of three hundred eighty-two and sixty-five hundredths feet to the <br />Northwest corner of said Lot One (1), being the said Point of Beginning. <br />The above -described easement and right-of-way containing a total of .14 <br />acres, more or less as shown on the plat dated 9/10/2024, marked Exhibit "A", <br />attached hereto and incorporated herein by reference, <br />together with the following rights: <br />Grantee shall have unrestricted ingress and egress to the above -described <br />easement and right-of-way for any purpose necessary for the surveying, construction, <br />inspection, maintenance, repair, replacement, relocation, extension, removal, and <br />operation of such public utilities and appurtenances. Such rights of ingress and egress <br />shall be exercised in a reasonable manner. <br />Grantee shall have the right to excavate and refill ditches and trenches necessary <br />for such public utilities and appurtenances; to remove, clear, and keep clear, trees, <br />bushes, hedges, undergrowth, and/or any other obstructions interfering with the <br />surveying, construction, inspection, maintenance, repair, replacement, relocation, <br />extension, removal, and operation of such public utilities and appurtenances. <br />Grantor shall have the right to use the easement and right-of-way for purposes not <br />inconsistent with Grantee's full enjoyment of the rights herein granted, provided that <br />Grantor shall not allow any structures, buildings, combustible materials, or other property <br />-2- <br />
