<br /> EASEMENT
<br /> DONALD S. ROUSH and MARLENE C. ROUSH, husband and wife, herein called �
<br /> �
<br /> Grantors, in consideration of the sum of One Dollar (51 .00), receipt of which is
<br /> hereby acknowledged, hereby grant and convey unto NEBRASKA MIL-NIC, INC., a
<br /> Nebraska corporation in Hall County, Nebraska, herein called Grantee, a permanent
<br /> and perpetual easement and right-of-way to survey, construct, inspect, maintain,
<br /> repair, replace, relocate, extend, remove, and operate thereon, public and private
<br /> utilities and appurtenances connected therewith, in, upon, above, along, over, across,
<br /> underneath, and through the easement and right-of-way being more particularly
<br /> described as follows:
<br /> A tract of land for easement purposes comprising a part of Lot One (1 ),
<br /> Firethorne Estates Subdivision in the City of Grand Island, Hall County,
<br /> Nebraska, said tract being more particularly described as follows:
<br /> With reference to the Southwest corner of said Lot 1 , thence running on
<br /> an assumed bearing of N 01 °23'07" W on the West line of said Lot 1
<br /> for a distance of 295.95 feet to the actual point of beginning; thence
<br /> continuing N 01 °23'07" W on the West line of said Lot 1 for 20.00 feet,
<br /> thence N 89°51 '16" E for 177.25 feet to the East line of an existing
<br /> utility easement recorded in Miscellaneous Book 18, Page 690 of the
<br /> Hall County, Nebraska, Register of Deeds records, thence S 01 °23'04"
<br /> E on the East line of said existing easement for 20.00 feet; thence S
<br /> 89°51 '16" W for 177.25 feet to the point of beginning, said tract
<br /> containing 3544 square feet more or less,
<br /> together with the following rights:
<br /> Grantee shall have unrestricted ingress and egress to the above-described
<br /> easement and right-of-way for any purpose necessary for the surveying, construction,
<br /> inspection, maintenance, repair, replacement, relocation, extension, removal, and
<br /> operation of such public and private utilities and appurtenances. Such rights of
<br /> ingress and egress shall be exercised in a reasonable manner.
<br /> Grantee shall have the right to excavate and refill ditches and trenches
<br /> necessary for such public and private utilities and appurtenances; to remove, clear,
<br /> and keep clear, trees, bushes, hedges, undergrowth, and/or any other obstructions
<br /> interfering with the surveying, construction, inspection, maintenance, repair,
<br /> replacement, relocation, extension, removal, and operation of such public and private
<br /> utilities and appurtenances.
<br /> Grantors shall have the right to use the easement and right-of-way for purposes
<br /> not inconsistent with Grantee's full enjoyment of the rights herein granted, provided
