202406657 <br />RESTRICTIVE COVENANT <br />Pursuant to provisions regarding the reuse of Nebraska Affordable Housing Trust Funds <br />between the State of Nebraska Department of Economic Development ("Department") and Central <br />Nebraska Growth Foundation, the following -described real property may be occupied only by <br />income -eligible person(s) and shall be subject to cost of housing and rent limitations in accordance <br />with applicable regulations and as set forth therein. <br />For the term of this Covenant, the NAHTF-assisted units under the Project shall be used primarily <br />to provide housing for eligible tenants making at or below One Hundred Twenty (120%) Area <br />Median Income (AMI). <br />The maximum rent allowed for the NAHTF-assisted units of the Project shall be no more than the <br />sixty-five (65%) rent limit as currently published by HUD in the HUD HOME Table found on the <br />Department's NAHTF web page, with adjustments for the number of bedrooms in the unit. <br />This restrictive covenant runs with the land and is binding on the current owner, Innate 8, <br />LLC, its successors, assigns, legal representatives and heirs for 10 years after filing, when this <br />covenant and restriction expires. <br />The legal description affected by this Restrictive Covenant is as follows: <br />Lots One (1), and Two (2), Legacy 34 Fifth Subdivision, Grand Island, Hall County, Nebraska <br />Executed this a1 day of \ c- 4 Q_., , 2024. <br />Central Nebraska Growth Foundation, <br />A Nebraska nonprofit corporation <br />By: <br />N. <br />Title: <br />The foregoing instrument was acknowledged before me this <br />Cr , 2024 by,,,Q,r,1,;c,,Qr,,S pa.-- , on behalf of Central Nebraska <br />Growth Foundation. �° ,�pp NOi y?, , <br />'`�� G NE....
