20240520? <br />Lot Seven (7), Westwood Park Thirteenth Subdivision in the City of Grand Island, Hall <br />County, Nebraska. <br />Lot Eight (8), Westwood Park Thirteenth Subdivision in the City of Grand Island, Hall <br />County, Nebraska. <br />WHEREAS, pursuant to Article III of the Restrictive Covenants, the Restrictive <br />Covenants may be changed or modified by a vote of a majority of the then owners of Lots Three <br />(3) through Eight (8), Westwood Park Thirteenth Subdivision in the City of Grand Island, Hall <br />County, Nebraska. As such, the owner of a majority of the lots that comprise the subject property <br />must approve this Amendment for said Amendment to be effective; <br />WHEREAS, after considerable discussion, the lot owners agreed that amending the <br />Restrictive Covenants of the Westwood Park Townhomes Homeowners' Association was in the <br />best interest of the Association. <br />NOW, THEREFORE, it is agreed as follows: <br />1. The recitals appearing hereinabove are hereby specifically incorporated herein <br />and made a binding part of this Amendment. <br />2. Article III, Paragraph 4, Section e. of the Restrictive Covenants shall hereinafter <br />appear and read as follows: <br />e. If the Board of Directors obtains and maintains insurance as decided in <br />Article VI, Section 1 of the By -Laws of Westwood Park Townhomes <br />Homeowners' Association, insurance on the buildings and improvements at <br />replacement value and said Association shall provide proof to the individual <br />owners of such coverage. In case the insurance proceeds are less than the <br />cost of repairs, the excess cost shall be paid by the owner of such Lot. All <br />damaged structures shall be rebuilt and/or replaced. At the option of the <br />Association, the owner of any Lot within the Properties shall take all action <br />necessary so that any company providing such insurance shall include <br />within such insurance coverage an appropriate loss payable clause naming <br />the Association as payee of insurance proceeds and this Article III, <br />Paragraph 4. shall constitute the consent of any such owner for any such <br />company providing such insurance to include within such insurance <br />coverage provisions for an appropriate loss payable clause naming the <br />Association as payee of insurance proceeds. Upon receipt of any insurance <br />proceeds hereunder, the Association shall deposit any insurance proceeds <br />for the benefit of the owner and disburse such insurance proceeds directly <br />toward repairing the damages suffered. <br />2 <br />
