Locust, Ste. 501 <br />Grand Island, NE 68801 <br />!HST 202/ 0 5 1 2 b <br />LICENSE AGREEMENT <br />This License Agreement is made and entered into this 1 day of <br />2024 by and between James Scharphom and Caroline Scharphorn, husband <br />("Licensor"), and Jerome J. Watson and Jane L. Watson, husband and wife ("Licensee"). <br />REFUNDS: <br />CASH <br />CHECK <br />RECORDED <br />HALL CC.Y I T Y NE <br />2024 OCT a t P 2: Ob <br />-ir is T i WOLD <br />REGISTER OF DEEDS <br />RECITALS: <br />wife <br />WHEREAS Licensor owns the property legally described as Lot Sixteen (16), Hidden <br />Lakes Subdivision Number Four, Hall County, Nebraska ("Licensor's Property"); and <br />WHEREAS, Licensee owns the property legally described as Lot Fifteen (15), Hidden <br />Lakes Subdivision Number Four, Hall County, Nebraska ("Licensee's Property"); and <br />WHEREAS, a fence constructed by Licensee encroaches upon Licensor's Property (the <br />"Fence") by approximately eighteen inches (18"); and <br />WHEREAS, Licensor and Licensee desire to enter into this Agreement concerning the <br />Fence. <br />NOW THEREFORE in consideration of execution of this Agreement, it is agreed by and <br />between the parties as follows: <br />1. Licensee may retain the Fence in its present location upon Licensor's Property at <br />Licensee's expense and risk subject to the following: <br />a. Licensee shall repair the Fence as needed. In the event the Fence is <br />destroyed or damaged to the extent it cannot be repaired, Licensee may <br />either replace or remove the Fence from Licensor's Property within six <br />(6) months after said irreparable destruction; and <br />b. This License shall terminate on December 31, 2049 unless earlier <br />terminated upon written agreement of the owners of Licensor's Property <br />and Licensee's Property. <br />2. Licensee acknowledges that the encroachment of the Fence upon Licensor's <br />Property and any past, present or future use, possession or occupancy of any part of Licensor's <br />Property by Licensee shall be considered consensual in nature and shall not ripen into any claim <br />by Licensee for adverse possession, prescriptive easement, use, ownership, access or occupancy <br />of Licensor's Property. <br />3. Licensee hereby waives any claim for damages against Licensor for any property <br />and personal injury damage or injury that may result to the Fence or from use of the Fence. <br />Licensee agrees to indemnify and hold Licensor harmless from any and all claims arising under <br />this License Agreement. <br />
