The Third Party Lender Agreement was subsequently recorded on 08/30/2017 as Instrument No. 201705845 in the Records of Hall County, Nebraska, relating to real estate described as: See Exhibit A. Since Five Points Bank executed the Third Party Lender Agreement, the Borrower has satisfied its obligation to the United States Small Business Administration and Nebraska Economic Development Corporation; which necessitates the termination of the Third Party Lender Agreement and Release of Five Points Bank from its obligations under the Third Party Lender Agreement. Premised upon the foregoing, Nebraska Economic Development Corporation, as Attorney in Fact for the United States Small Business Administration, an agency of the United States of America and assignee of the Third Party Lender Agreement, hereby terminates the Third Party Lender Agreement and releases Five Points Bank from its obligations under the Third Party Lender Agreement.
