Shada and Stacy J. Shada, a married couple, and Brandon M. Shada, <br />hereby surrender and terminate the Lease agreement by which they are the Lessees and Kuester Lake, Inc. is <br />Lessor, said Lease dated May 24, 2023, recorded on May 24, 2023, as Instrument No. 202302492, and <br />assignment of Lease filed May 24, 2023, to Equitable Bank, and recorded as Instrument No. 202302494. <br />Said Lease pertains to: <br />Lot Sixteen (16) and Seventeen (17), having a lake front footage of one hundred ninety (190) <br />feet, situated on the East side of the West portion of Kuester's Lake and being a part of the East <br />Half (El/2) of the Southwest quarter (SW'/a) in Section Thirteen (13), Township Eleven (11) <br />North, Range Nine (9), West of the 6th P.M., Hall County, Nebraska, bounded on the Easterly <br />side by the common road; <br />TOGETHER WITH <br />A tract of land situated on the northerly side of Lot Eighteen (18) on the East side of the West <br />portion of Kuester Land and being part of the East Half (E'/2) of the Southwest quarter (SW1/4) of <br />Section Thirteen (13), Township Eleven (11) North, Range Nine (9), West of the 6th P.M., Hall <br />County, Nebraska, bounded on the Easterly side by the common road as shown on a plat in the <br />possession of Kuester Lake, Inc., the Lessor, and more particularly described as follows: <br />Commencing at a point on the Northerly line of said Lot Eighteen (18) and which point is One <br />hundred fifty-eight and five tenths (158.5) feet Westerly from the Northeast corner of said Lot <br />Eighteen (18); and then running Westerly on an extension of the Northerly line of said Lot <br />Eighteen (18), for a distance of Twelve (12) feet; deflecting then left 116° and running thence <br />Southwesterly to the shore line, as the same may exist from time to time based upon the lake <br />level of Kuester Lake; and then running Southeasterly along and upon such shore line to a point, <br />and such point is the Southwesterly end of a line measured as follows; commencing at a point on <br />the Northerly line of said Lot Eighteen (18) and which point is One hundred fifty-eight and five <br />tenths (158.5) feet Westerly from the Northeast corner of said Lot Eighteen (18); and then <br />running Westerly on an extension of the Northerly line of said Lot Eighteen (18), thence <br />deflecting then left 64° and running thence Southwesterly to the shore line and being the point <br />referred to at the end of the paragraph next above. <br />EXCEPTING THEREFROM <br />A tract of land situated on the Southerly side of Lot Seventeen (17) on the East side of the West <br />portion of Kuester Land and being part of the East Half (E'/2) of the Southwest quarter (SW1/4) of <br />Section Thirteen (13), Township Eleven (11) North, Range Nine (9), West of the 6th P.M., Hall <br />County, Nebraska, bounded on the Easterly side by the common road as shown on a plat in the <br />possession of Kuester Lake, Inc., the Lessor, and more particularly described as follows: <br />Commencing at the Southeasterly corner of said Lot Seventeen (17) and running thence parallel <br />to the Westerly side of the common road and for a distance of Ten (10) feet; running thence <br />Westerly for a distance of One hundred fifty-nine and five tenths (159.5) feet to where such line <br />intersects the Southerly line of said Lot Seventeen (17); and which is One hundred fifty-eight <br />and five tenths (158.5) feet Westerly from the Southeasterly corner of said Lot Seventeen (17); <br />thence running Easterly along and upon the Southerly line of said Lot Seventeen (17) for a <br />
