<br />That Melodie J. Carlin, a single person, the "Grantor", of Hall County, Nebraska, for and in consideration
<br />of the sum of one dollar ($1.00) and other good and valuable consideration, the receipt of which is hereby
<br />acknowledged, does hereby grant, remise, convey and relinquish unto NorthWestern Energy Public Service
<br />Corporation, a South Dakota corporation, d/b/a NorthWestern Energy, the "Grantee", with its principal
<br />operations office located at 600 Market Street West, Huron, South Dakota 57350, its successors or assigns, a gas
<br />utility easement for the installation, maintenance and operation of an underground natural gas pipeline along with all
<br />appurtenances thereto over, under, upon and through the following described real estate in the County of Hall, State
<br />of Nebraska, to -wit:
<br />A 10 -foot -wide tract of land located in part of Lot One (1), Block Subdivision, located in part
<br />of the Northeast Quarter (NE1/4) of Section Two (2), Township Ten North (T10N), Range Ten
<br />West (R10W) of the 6th Principal Meridian, Hall County, Nebraska, and more particularly
<br />described as follows:
<br />Commencing at the Northeast (NE) corner of Section 2; thence on an assumed bearing of
<br />South 00°13'20" West, along the East line of the Northeast Quarter (NE114), a distance of
<br />1192.74 feet; thence South 89°58'25" West, a distance of 48.35 feet to a point on the North
<br />line of Lot 1, Block Subdivision, and also being the Point of Beginning; thence on an assumed
<br />bearing of South 00°37'17" West, parallel to the West line of a Prescriptive Road Easement
<br />surveyed by L.R. Rudd dated 5/10/1942, a distance of 126.58 feet to a point on the South line
<br />of said Lot 1, Block Subdivision; thence South 89°56'52" West, along said South line of Lot
<br />1, Block Subdivision, a distance of 10.00 feet; thence North 00°37'17" East, parallel to said
<br />West line of the Prescriptive Road Easement, a distance of 126.59 feet to a point on the North
<br />line of said Lot 1, Block Subdivision; thence North 89°58'30" East, along the North line of said
<br />Lot 1, Block Subdivision, a distance of 10.00 feet to the Point of Beginning; as illustrated in
<br />Exhibit "A" attached hereto. Said tract of land containing 0.029 acres, more or less.
<br />[The purpose of the above-described easement is for an underground natural gas pipeline
<br />along with all appurtenances thereto (the "Facilities").]
