<br />GAS UTILITY EASEMENT
<br />KNOW ALL MEN BY THESE PRESENTS:
<br />That Sharon L. Nolan, Trustee of the Sharon L. Nolan Revocable Living Trust, the "Grantor", of Hall
<br />County, Nebraska, for and in consideration of the sum of one dollar ($1.00) and other good and valuable
<br />consideration, the receipt of which is hereby acknowledged, does hereby grant, remise, convey and relinquish unto
<br />NorthWestern Energy Public Service Corporation, a South Dakota corporation, d/b/a NorthWestern Energy,
<br />the "Grantee", with its principal operations office located at 600 Market Street West, Huron, South Dakota 57350, its
<br />successors or assigns, a gas utility easement for the installation, maintenance and operation of an underground
<br />natural gas pipeline along with all appurtenances thereto over, under, upon and through the following described real
<br />estate in the County of Hall, State of Nebraska, to -wit:
<br />A 10 -foot -wide tract of land located in part of Lots Two (2) and Three (3), Block Subdivision,
<br />located in part of the Northeast Quarter (NE1/4) of Section Two (2), Township Ten North
<br />(T10N), Range Ten West (R10W) of the 6th Principal Meridian, Hall County, Nebraska, and
<br />more particularly described as follows:
<br />Commencing at the Northeast (NE) corner of Section 2; thence on an assumed bearing of
<br />South 00°13'20" West, along the East line of the Northeast Quarter (NE1/4), a distance of
<br />991.20 feet; thence South 89°58'25" West, a distance of 46.94 feet to a point on the North line
<br />of Lot 3, Block Subdivision, and also being the Point of Beginning; thence South 00°37'17"
<br />West, parallel to the West line of a Prescriptive Road Easement surveyed by L.R. Rudd dated
<br />5/10/1942, a distance of 201.55 feet to a point on the North line of Lot 1, Block Subdivision;
<br />thence South 89°58'30" West, along said North line of said Lot 1, Block Subdivision, a
<br />distance of 10.00 feet; thence North 00°37'17" East, parallel to said West line of the
<br />Prescriptive Road Easement, a distance of 201.56 feet to a point on the North line of Lot 3,
<br />Block Subdivision; thence South 89°58'39" East, along said North line of Lot 3, Block
<br />Subdivision, a distance of 10.00 feet to the Point of Beginning; as illustrated in Exhibit "A"
<br />attached hereto. Said tract of land containing 0.046 acres, more or less.
<br />[The purpose of the above-described easement is for an underground natural gas pipeline
<br />along with all appurtenances thereto (the "Facilities").]
