Kuta, a widower, as life tenant, of Hall County, Nebraska, and Fred A. Kuta, alkla <br />Frederic A. Kuta, an undivided one-third (1/3) interest, as remainderman, of Clay County, Nebraska, Frank A. <br />Kuta, alkla Franklin A. Kuta, an undivided one-third (113) interest, as remainderman, of Howard County, <br />Nebraska, and Jenifer S. Cantrell, an undivided one-third (113) interest, as remainderman, of Lancaster County, <br />Nebraska, all together as "Grantor", for and in consideration of the sum of one dollar ($1.00) and other good and <br />valuable consideration, the receipt of which is hereby acknowledged, do hereby grant, remise, convey and relinquish <br />unto NorthWestern Energy Public Service Corporation, a South Dakota corporation, d/b/a NorthWestern <br />Energy, the "Grantee", with its principal operations office located at 600 Market Street West, Huron, South Dakota <br />57350, its successors or assigns, a gas utility easement for the installation, maintenance and operation of an <br />underground natural gas pipeline along with all appurtenances thereto over, under, upon and through the following <br />described real estate in the County of Hall, State of Nebraska, to -wit: <br />A 10 -foot -wide tract of land located in part of the Northeast Quarter of the Northeast Quarter <br />of the Northeast Quarter (NE1/4 NE114 NE1/4) and in part of the North Half of the Southeast <br />Quarter of the Northeast Quarter of the Northeast Quarter (N112 SE114 NE1/4 NE1/4) of Section <br />Two (2), Township Ten North (T10N), Range Ten West (R10W) of the 6th Principal Meridian, <br />Hall County, Nebraska, and more particularly described as follows: <br />Commencing at the Northeast (NE) corner of said Section 2; thence on an assumed bearing <br />of South 00°13'20" West, along the East line of the Northeast Quarter (NE1/4), a distance of <br />33.00 feet; thence South 089°58'25" West, a distance of 40.27 feet to the Point of Beginning; <br />thence South 00°3717" West, parallel to the West line of a Prescriptive Road Easement <br />surveyed by L.R. Rudd dated 5/1011942, a distance of 958.25 feet to a point on the North line <br />of Lot 3, Block Subdivision; thence North 89°58'39" West, along said North line of said Lot 3, <br />Block Subdivision, a distance of 10.00 feet; thence North 00°37'17" East, parallel to said West <br />line of the Prescriptive Road Easement, a distance of 958.25 feet to a point on the South right- <br />of-way line of Schimmer Drive; thence North 89°58'25" East, along said South right-of-way <br />line, a distance of 10.00 feet to the Point of Beginning; as illustrated in Exhibit "A" attached <br />hereto.
