Box 1060 <br />Kearney, NE 68848-1060 <br />PERMANENT UTILITY EASEMENT <br />In consideration of the covenants and agreements expressed herein, the sum <br />of $1.00, and other good and valuable consideration, receipt of which is <br />acknowledged, Westgate Properties, LLC, a Nebraska limited liability company <br />"Grantor," grants, releases and conveys to the City of Grand Island, Nebraska <br />"Grantee" or "City," a private, perpetual right-of-way over and across and a <br />permanent easement in, over, under, upon and through the following described real <br />estate (as defined in Neb. Rev. Stat. § 76-201): <br />See attached Exhibit A (hereinafter referred to as the "Real Estate"), <br />for the purpose of clearing, trenching for, laying, constructing, operating, <br />using, replacing, inspecting, repairing, maintaining and removing, in whole or in <br />part, electrical lines, water lines, gas lines, cable/internet/phone lines, and sanitary <br />and drainage sewer lines (collectively "Utility Lines"), together with the right of <br />access to said easement for said purposes and to ingress and egress over the <br />easement for regular maintenance and emergency response of the Utility Lines, to <br />be located in, over, under and/or upon the Real Estate. A map of the Real Estate <br />created by Olsson is attached hereto as Exhibit B. <br />Grantor covenants and agrees not to: (i) Place or locate any permanent <br />structures on or upon the easement areas described above; and (ii) Interfere with <br />the City's reasonable access to and use of the easement areas for easement <br />purposes. Grantee covenants and agrees that, Grantee, its agents and employees, <br />assigns and successors shall, as soon as practicable after construction of the Utility <br />Lines, and all subsequent alterations and repairs thereto, restore affected property <br />of the Grantor to a neat and presentable condition and to its preconstruction <br />condition. <br />1 <br />
