<br />ELECTRIC UTILITY RIGHT-OF-WAY EASEMENT
<br />KNOW ALL MEN BY THESE PRESENTS, that the undersigned Eldon L. Kroeger, Trustee of the Eldon L.
<br />Kroeger Revocable Trust dated August 25, 2016, and Peggy J. Kroeger, Trustee of the Peggy J. Kroeger Revocable
<br />Trust dated August 25, 2016, as equal tenants in common , and their successors or assigns, collectively "Grantor",
<br />for and in consideration of the amount set forth in this easement, does hereby grant unto Southern Public Power
<br />District and its successors or assigns, collectively "Grantee"; a utility easement upon the lands of the Grantor,
<br />situated in the County of Hall , State of Nebraska and more particularly described as follows:
<br />SEE EXHIBIT "A" ATTACHED HERE TO AND BY THIS REFERENCE MADE A PART HEREOF
<br />Grantor hereby grants the right to construct, operate, repair, maintain, relocate, and replace electric utility line
<br />facilities, together with the necessary appurtenances, in, over, and upon the above-described easementlong with
<br />rights of ingress and egress.
<br />The Grantor shall maintain all other rights of possession, including rights of ingress and egress over the easement
<br />properties described above.
<br />The Grantor shall not construct any buildings, structures, signs, or light poles, or plant any trees or shrubbery, over
<br />or on said easement area without the prior express written consent of the Grantee.
<br />Compensation for this easement shall be in the amount of $1.00, receipt of which is hereby acknowledged.
<br />The undersigned covenants that he is the owner of the above-described lands and that the said lands are free and
<br />clear of encumbrances and liens of whatsoever character except covenants, conditions, easements, and restrictions of
<br />record.
<br />It is further understood that, whenever necessary, words used in this instrument in the singular shall be construed to
<br />read in the plural and that words used in the masculine gender shall be construed to read in the feminine.
