202402856 <br />AN <br />AGREEMENT <br />This Agreement is between David Gartner, the owner of property located at 330 Renee <br />Rd., Doniphan, Nebraska and legally described as Lot 49, Amick Acres West Subdivision, Hall <br />County Nebraska, (hereafter referred to as the Owner,) and the Serenity Lake Homeowners <br />Association, Inc. <br />Background. An organizational meeting of Serenity Lake Homeowners Association for <br />the owners of property in the Amick Acres Third Subdivision, and the Trinity, Serenity Lake and <br />Amick Acres Fourth Subdivisions was held on May 5, 2024. All property owners of the <br />mentioned subdivisions have access and use of the common area referred to as the Lake Lot, and <br />legally described as Lot Fifteen, Amick Acres Third Subdivision. <br />Also, present at the organizational meeting was David Gartner, the owner of Lot 49 of the <br />Amick Acres West Subdivision. While his property is a part of the Amick Acres West <br />Subdivision, his lake access is on, and his property are adjacent to Lot 15, the Lake Lot of the <br />Amick Acres Third Subdivision. <br />Therefore. It is the desire and intention of David Gartner as owner of Lot 49 Amick <br />Acres West to permanently join the Serenity Lake Homeowners Association to insure his current <br />and future use of the Lake Lot, and it is the intent of the Serenity Lake Homeowners Association <br />and its members to accept David Gartner, and all future owners of Lot 49, Amick Acres West <br />Subdivision, as a permanent and full voting member of the Serenity Lake Homeowners <br />Association. <br />As the Owner(s), he/she shall be entitled to the same full rights, uses, and privileges as <br />any other member in the Serenity Lake Homeowners Association, and he or she shall also be <br />responsible for abiding by all the rules, regulations, and requirements of the Agreement for <br />Protective Covenants for the Serenity Lake Homeowners Association adopted at a special <br />meeting by all members, including the Owner, on May 5, 2024. Such responsibilities shall <br />include, but not limited to, annual and special assessments of the Serenity Lake Homeowners <br />Association, but not road assessments. <br />This Agreement shall not nullify or void any responsibilities or duties the Owner may <br />have to or regarding the Amick Acres West Homeowners Association.
