I I <br />KRIS WO LD <br />REGISTER OF DEEDS <br />THIS PRIVATE ACCESS EASEMENT is made and entered into this 7 day of <br />c.)%4 ,.L , 2024, by and between A & H HOLDINGS, L.L.C., a Nebraska limited <br />liability company ("Grantor"), and HIGHLAND NORTH HOA, INC., a Nebraska nonprofit <br />corporation ("Grantee"). <br />RECITALS: <br />WHEREAS, Grantor is the Owners of: <br />Lots One (1) through Ten (10), Highland North First Subdivision, located in the City of <br />Grand Island, Hall County, Nebraska; and <br />Lots Seven (7) through Twenty-six (26), Highland North Second Subdivision, located in <br />the City of Grand Island, Hall County, Nebraska; and <br />WHEREAS: Grantor wishes to grant to Grantee, a private easement, as more particularly <br />defined herein (the "Easement"), for Grantee's use in the construction and maintenance of <br />private service utilities and public service utilities as deemed necessary by the Grantee, together <br />with the rights of ingress and egress hereto, and hereby prohibiting the planting of trees, bushes <br />and shrubs, or placing other obstructions upon, over, along or underneath the surface of such <br />Easement, except at the discretion of Grantee. <br />The Easement Defined: <br />A 10' wide private easement located along the East side of Lot 26 Highland North <br />Second Subdivision, located in the City of Grand Island, Hall County, Nebraska <br />more particularly described as follows: beginning on the Southeast corner of Lot <br />26 Highland North Second Subdivision, thence on an assumed bearing of N <br />89°58'00" W on the South line of Lot 26 a distance of 10.0 feet; thence N <br />00°48'54" W a distance of 165.18 feet; thence S 72°46' 17" E a distance of 10.52 <br />feet to a point on the East line of said Lot 26; thence S 00°48'54" E on said East <br />line of Lot 26 a distance of 162.07 feet to the point of beginning. Said easement <br />contains a calculated area of 1636.22 square feet or 0.04 acres more or less. <br />A 7' wide private easement located along the North side of Lots 1-5 Highland <br />North First Subdivision, in the City of Grand Island, Hall County, Nebraska more <br />particularly described as follows: beginning at the Northwest corner of Lot 1 <br />Highland North First Subdivision, thence S 89°58'00" E on the North line of said <br />Highland North First Subdivision a distance of 390.97 feet to a point on the North <br />line of Lot 5, Highland North First Subdivision; thence S 00°02'00" W a distance <br />of 7.0 feet; thence N 89°58'00" W a distance of 390.97 feet to a point on the West <br />line of said Lot 1; thence N 00°02'00" W on said West line a distance of 7.0 feet <br />back to the point of beginning. Said easement contains a calculated area of <br />2737.12 square feet or 0.06 acres more or less. <br />
