RECITALS: WHEREAS, Grantor is the Owners of: Lots One (1) through Six (6), Highland North Second Subdivision, located in the City of Grand Island, Hall County, Nebraska; and WHEREAS: Grantor wishes to grant to Grantee, a private easement, as more particularly defined herein (the "Easement"), for Grantee's use in the construction and maintenance of private service utilities and public service utilities as deemed necessary by the Grantee, together with the rights of ingress and egress hereto, and hereby prohibiting the planting of trees, bushes and shrubs, or placing other obstructions upon, over, along or underneath the surface of such Easement, except at the discretion of Grantee. The Easement Defined: Those certain portions of the following easement which are located on Lots One (1) through Six (6), Highland North Second Subdivision in the City of Grand Island, Hall County, Nebraska: A 7' wide private easement located along the South side of Lots 1-10 Highland North Second Subdivision, in the City of Grand Island, Hall County, Nebraska more particularly described as follows: beginning at the Southwest corner of Lot 10 Highland North Second Subdivision, thence N 00°02'00" E on the West line of said Lot 10 a distance of 7.0 feet; thence S 89°58'00" E a distance of 457.57 feet; thence S 00°48'54" E a distance of 7.0 feet to a point on the South line of Lot 1 Highland North Second Subdivision; thence N 89°58'00" W on the South line of said Highland North Second Subdivision a distance of 457.68 feet back to the point of beginning. Said easement contains a calculated area of 3203.39 square feet or 0.07 acres more or less. NOW, THEREFORE, in consideration of the mutual covenants set forth herein, it is agreed as follows: 1. For good and valuable consideration, Grantor hereby grants and conveys unto Grantee, and Grantee's heirs, successors and assigns, the Easement, as herein defined, for the purposes specified herein.
