Locust, Ste. 501 <br />Grand Island, NE 68801 <br />INS T 20211 0 2 b 1 1 <br />PRIVATE ACCESS EASEMENT <br />CASH <br />CHECK 27 <br />REFUNDS: <br />CASH <br />CHECK <br />fJ <br />HA !-E '.;" ; i NE <br />(1: 12 <br />REGISTER OF DEE <br />THIS PRIVATE ACCESS EASEMENT is made and entered into this LQ " day of <br />)VA, , 2024, by and between ALLOWAY HOLDINGS, L.L.C., a Nebraska <br />limited liability company ("Grantor"), and HIGHLAND NORTH HOA, INC., a Nebraska <br />nonprofit corporation ("Grantee"). <br />RECITALS: <br />WHEREAS, Grantor is the Owners of: <br />Lots One (1) through Six (6), Highland North Second Subdivision, located in the City of <br />Grand Island, Hall County, Nebraska; and <br />WHEREAS: Grantor wishes to grant to Grantee, a private easement, as more particularly <br />defined herein (the "Easement"), for Grantee's use in the construction and maintenance of <br />private service utilities and public service utilities as deemed necessary by the Grantee, together <br />with the rights of ingress and egress hereto, and hereby prohibiting the planting of trees, bushes <br />and shrubs, or placing other obstructions upon, over, along or underneath the surface of such <br />Easement, except at the discretion of Grantee. <br />The Easement Defined: <br />Those certain portions of the following easement which are located on Lots One <br />(1) through Six (6), Highland North Second Subdivision in the City of Grand <br />Island, Hall County, Nebraska: <br />A 7' wide private easement located along the South side of Lots 1-10 Highland North <br />Second Subdivision, in the City of Grand Island, Hall County, Nebraska more <br />particularly described as follows: beginning at the Southwest corner of Lot 10 Highland <br />North Second Subdivision, thence N 00°02'00" E on the West line of said Lot 10 a <br />distance of 7.0 feet; thence S 89°58'00" E a distance of 457.57 feet; thence S 00°48'54" E <br />a distance of 7.0 feet to a point on the South line of Lot 1 Highland North Second <br />Subdivision; thence N 89°58'00" W on the South line of said Highland North Second <br />Subdivision a distance of 457.68 feet back to the point of beginning. Said easement <br />contains a calculated area of 3203.39 square feet or 0.07 acres more or less. <br />NOW, THEREFORE, in consideration of the mutual covenants set forth herein, it is <br />agreed as follows: <br />1. For good and valuable consideration, Grantor hereby grants and conveys unto <br />Grantee, and Grantee's heirs, successors and assigns, the Easement, as herein defined, for the <br />purposes specified herein. <br />
