202402377 <br />and items incidental or related thereto which may be under, upon or over Outlots A -C inclusive <br />which shall be completed at the expense of the benefitted Lot Owners. Additionally, the benefitted <br />Lot Owners shall be responsible for restoring Outlots A -C inclusive to its condition as it existed <br />prior to such construction, replacement, maintenance or repairs. <br />10. Design and Construction. No building shall be constructed except within the <br />Building Envelope Areas as defined on the Development Plan. The buildings to be constructed in the <br />RD Residential Development Zone, lots 1-8 inclusive, shall be consistent with the designs approved <br />with the development plan including 155 units of apartments in three story buildings with 22 units <br />per building as shown in the attached development plan and attached elevations and floor plans and <br />one carriage house with one dwelling unit in each carriage house. No portion of any building <br />constructed (including architectural features) shall exceed a height of 50 feet above the center of the <br />street at the midpoint of the front property line. <br />11. Care and Maintenance. Subdivider acknowledges and understands that at <br />all times during the development process and at all times thereafter the property must be maintained <br />in compliance with City Code including insuring that no grass, weeds, or worthless vegetation <br />accumulates and that the property remains free and clear of any prohibited garbage, waste, rubbish or <br />construction debris except for construction materials as allowed by law. Subdivider will ensure all <br />contractors, subcontractors, current and subsequent owners, or successors and assigns are notified of <br />their obligations to maintain the property as required by City Code. <br />12. Easements. Any easements shall be kept free of obstructions and the <br />Subdivider shall indemnify the City for any removal or repair costs caused by any obstructions. In <br />5 <br />
