200400393 <br />(11) North, Range Nine (9) West of the 6th P.M., located in the city of <br />Grand Island, Hall County, Nebraska; thence southerly on an ASSUMED <br />bearing of S00 046'05 "E along the westerly line of the West Half of the <br />Southeast Quarter (W1/2, SE1 /4), a distance of one thousand sixty eight <br />and eighty six hundredths (1068.86) feet to the southwest corner of the <br />tract conveyed by the deed recorded as Document Number 200111152 in <br />the Register of Deeds Office, Hall County, Nebraska; thence northeasterly <br />on a bearing of N57 001'19 "E along the southerly line of the said tract, a <br />distance of five hundred sixty eight and forty two hundredths (568.42) feet; <br />thence easterly on a bearing of N87 056'27 "E, continuing along the <br />southerly line of the said tract, a distance of seven hundred seventy two <br />and eighty hundredths (772.80) feet; thence northerly along the easterly <br />line of the said tract on a bearing of N00 °51'58 "W, a distance of one <br />hundred seventy six ana twenty six hundredths (176.26) feet to the <br />ACTUAL point of beginning; thence southwesterly on a bearing of <br />S74 °37'17 "W, a distance of five hundred thirty six and fifty one hundredths <br />(536.51) feet to the point of termination. <br />The above - described easement and right -of -way containing 0.246 acres, <br />more or less, as shown on the plat dated 12/26/2003, marked Exhibit "A" <br />attached hereto and incorporated herein by reference, <br />together with the following rights: <br />Grantee shall have unrestricted ingress and egress to the above - described <br />easement and right -of -way for any purpose necessary for the surveying, construction, <br />inspection, maintenance, repair, replacement, relocation, extension, removal, and <br />operation of such public utilities and appurtenances. Such rights of ingress and egress <br />shall be exercised in a reasonable manner. <br />Grantee shall have the right to excavate and refill ditches and trenches <br />necessary for such public utilities and appurtenances; to remove, clear, and keep clear, <br />trees, bushes, hedges, undergrowth, and /or any other obstructions interfering with the <br />surveying, construction, inspection, maintenance, repair, replacement, relocation, <br />extension, removal, and operation of such public utilities and appurtenances. <br />-2- <br />
