NE 68824 a NF(oago3 <br />MODIFICATION OF DEED OF TRUST <br />THIS MODIFICATION OF DEED OF TRUST DATED December 27, 2019, is made and executed between Tammy <br />Pham, A Single Person , ("Trustor"); Pathway Bank, a Nebraska Banking Corporation, whose mailing address is <br />Grand Island Branch, 3333 W State St, Grand Island, Nebraska, 68803, hereinafter (referred to below sometimes as <br />"Lender" and sometimes as "Beneficiary"); and Pathway Bank, whose address is 3333 W State St, Grand Island, NE <br />68803 (referred to below as "Trustee"). <br />DEED OF TRUST: Lender and Trustors have entered into a Deed of Trust dated December 27, 2019, which has <br />been recorded in Hall County, State of Nebraska as follows: <br />Recorded Instrument Number: 202000005 <br />REAL PROPERTY DESCRIPTION: The Deed of Trust covers the following described real property located as <br />Multiple Investment properties in Grand Island, NE 68803 Hall County, State of Nebraska: <br />See Attached Exhibit "A" <br />Partial Deed of Reconveyance Recorded Instrument Number: 202105187 <br />Partial Deed of Reconveyance Recorded Instrument Number: 202104860 <br />Modification, Lender and Trustors hereby modify the Deed of Trust as follows: <br />FUTURE ADVANCES. In Addition to the Note, this Deed of Trust secures all future advances made by Lender to <br />Trustor whether or not the advances are made pursuant to a commitment. Specifically, without limitation, this Deed <br />of Trust secures, in addition to the amounts specified in the Note, all future amounts Lender in its discretion may <br />loan to Trustor, together with all interest thereon. <br />Trustor presently assigns to Lender (also known as Beneficiary in this Deed of Trust) all of Trustor's right, title, and <br />interest in and to all present and future leases of the Property and all Rents from the Property. In addition, Trustor <br />grants to Lender a Uniform Commercial Code security interest in the Personal Property and Rents. <br />Continuing Validity: Except as expressly modified above, the terms of the original Deed of Trust shall remain <br />unchanged and in full force and effect. Consent by Lender to this modification does not waive Lender's right to <br />require strict performance of the Deed of Trust as changed above nor obligate Lender to make any future <br />modifications. Nothing in this Modification shall constitute a satisfaction of the promissory note or other credit <br />agreement secured by the Deed of Trust (the "Note"). It is the intention of Lender to retain as liable all parties to the <br />Deed of Trust and all parties, makers and endorsers to the Note, including accommodation parties, unless a party is <br />expressly released by Lender in writing. Any maker or endorser, including accommodation makers, shall not be <br />released by virtue of this Modification. If any person who signed the original Deed of Trust does not sign this <br />Modification, then all persons signing below acknowledge that this Modification is given conditionally, based upon <br />the representation to Lender that the non -signing person consents to the changes and provisions of this Modification <br />or otherwise will not be released by it. This waiver applies not only to any initial extension or modification, but also <br />to all such subsequent actions. <br />TRUSTORS ACKNOWLEDGE HAVING READ ALL THE PROVISIONS OF THIS MODIFICATION OF <br />DEED OF TRUST AND TRUSTORS AGREE TO ITS TERMS.
