NE 68824 a NF(oago3 MODIFICATION OF DEED OF TRUST THIS MODIFICATION OF DEED OF TRUST DATED December 27, 2019, is made and executed between Tammy Pham, A Single Person , ("Trustor"); Pathway Bank, a Nebraska Banking Corporation, whose mailing address is Grand Island Branch, 3333 W State St, Grand Island, Nebraska, 68803, hereinafter (referred to below sometimes as "Lender" and sometimes as "Beneficiary"); and Pathway Bank, whose address is 3333 W State St, Grand Island, NE 68803 (referred to below as "Trustee"). DEED OF TRUST: Lender and Trustors have entered into a Deed of Trust dated December 27, 2019, which has been recorded in Hall County, State of Nebraska as follows: Recorded Instrument Number: 202000005 REAL PROPERTY DESCRIPTION: The Deed of Trust covers the following described real property located as Multiple Investment properties in Grand Island, NE 68803 Hall County, State of Nebraska: See Attached Exhibit "A" Partial Deed of Reconveyance Recorded Instrument Number: 202105187 Partial Deed of Reconveyance Recorded Instrument Number: 202104860 Modification, Lender and Trustors hereby modify the Deed of Trust as follows: FUTURE ADVANCES. In Addition to the Note, this Deed of Trust secures all future advances made by Lender to Trustor whether or not the advances are made pursuant to a commitment. Specifically, without limitation, this Deed of Trust secures, in addition to the amounts specified in the Note, all future amounts Lender in its discretion may loan to Trustor, together with all interest thereon. Trustor presently assigns to Lender (also known as Beneficiary in this Deed of Trust) all of Trustor's right, title, and interest in and to all present and future leases of the Property and all Rents from the Property. In addition, Trustor grants to Lender a Uniform Commercial Code security interest in the Personal Property and Rents. Continuing Validity: Except as expressly modified above, the terms of the original Deed of Trust shall remain unchanged and in full force and effect. Consent by Lender to this modification does not waive Lender's right to require strict performance of the Deed of Trust as changed above nor obligate Lender to make any future modifications. Nothing in this Modification shall constitute a satisfaction of the promissory note or other credit agreement secured by the Deed of Trust (the "Note"). It is the intention of Lender to retain as liable all parties to the Deed of Trust and all parties, makers and endorsers to the Note, including accommodation parties, unless a party is expressly released by Lender in writing. Any maker or endorser, including accommodation makers, shall not be released by virtue of this Modification. If any person who signed the original Deed of Trust does not sign this Modification, then all persons signing below acknowledge that this Modification is given conditionally, based upon the representation to Lender that the non -signing person consents to the changes and provisions of this Modification or otherwise will not be released by it. This waiver applies not only to any initial extension or modification, but also to all such subsequent actions. TRUSTORS ACKNOWLEDGE HAVING READ ALL THE PROVISIONS OF THIS MODIFICATION OF DEED OF TRUST AND TRUSTORS AGREE TO ITS TERMS.
