<br />34-11 Maintenance Of Facilities
<br />Each registrant shelf maintain its facilities in good and safe condition and in a manner that complies with all

<br />34-l200 a Removal Of Fadlales
<br />1. Within thirty (30) days following written notice from the Oty, a registrant shall, al its own expense,
<br />temporarily or permanently remove. relocate, change or alter the position of any telecommunications
<br />tacit itiesvaithin thepublic ways whenever thealy Administrator shall hanedetermined that such removal,
<br />relocation, changed allnation is reasonably necessary for:
<br />1. The const ruction, repair,maintenance or installation bythe Oly or other governmental entity of any
<br />pudir, improvernent in or upon the public ways.
<br />2. The operations of the City or other governmental entity in or upon the public ways.
<br />3. The vacation of a public street or the release of a utility easement.
<br />2. Provided theoty has complied with the One Call Notification System Ad the afy shall not be liable for any

<br />with any public works. public improvements, construction. eicayarioe.grading.1illing or work of any Mind

<br />34-13 Removal Of Unauthorized Fadlitlq
<br />Within thirty (30) days following written noticefrom the aty.any registrant or other person that owns, controls or
<br />maintains any unauthorized telecommunications systern. Iailily or related appurtenenceswithtn the public ways
<br />shall at as awn expense, remove such radlities or appurtenances from the pudic ways If such registrant or
<br />responsible person fails to remove such facilities or appurtenances, thealy may cause the removal and charge the
<br />registrant or respon sibleperson for Ihecosts incurred. A telecom munications system or facility is unaul holzed and
<br />abject to removal in the following circumstances.
<br />1. Upon abandonment of a facility within the pudic ways.
<br />2. If the system or facility was constructed a installed without the prior issuance of a required construction
<br />permit.
<br />3. If the system or facility was coed Rioted or installed ata location not permitted by Meaty
<br />4. Any such other circumstances deemed reasonably necessary by the sly Administrator in order to protect
<br />pudic heaith,sately and welfare.

<br />The sly retains the right and priv ilege to cut or emu a any telecommunications facilities located within the pubic
<br />ways as the City may determine to be necessary, appropriate or useful in response to any public health or safely
<br />emergency. Theaty shall use its best efforts tonolify the grantee through its Emergency Management Department
<br />and the Che Call Notification Syslen Ad prior Moulting or moving the grantee's telecommunication facilities.
<br />34-16Rattdrabon Of WgIlta.Of-Win
<br />The Registrant shall comply with thefollowing:
<br />1. When a registrant.or any person acting on its behalf, does any work in or affecting any publicways,it shall.
<br />at its own expense, promptly remove any obstructions therefrom and restore such ways or properly
<br />including trees. landscaping and grounds to the same ondition which erisld before the work was
<br />undertaken.
<br />2 If weather or other conditions do not permit I he complelerestorat ion required hereunder.lhe registrant shall
<br />temporarily restore the affected ways or property. Such temporary restoration shall be 0 the registrant's
<br />sole expense and the registrant shall promptly undertake and corn ploethe required permanent restoration
<br />when theweelhor conditions no longer prevent such permanent restoration.
<br />3 A registrant or other perem ming on its behalf shall use suitable barricades, flags, flagmen, lights. flares
<br />and other rneasuresas required cul the solely of all mambas of the general public and to present injury 01
<br />dam age to any person, vehicle or property by reason of such work in or affecting such public ways.
