202402094 <br />4. Storm Drainage. The Subdivider agrees to provide and maintain positive <br />drainage from all lots, according to the drainage plan, so that storm drainage is conveyed to a public <br />right-of-way or to other drainage systems so approved by the Director of Public Works. If the <br />Subdivider fails to grade and maintain such drainage the City may create a drainage district to <br />perform such work. The Subdivider agrees to waive the right to object to the creation of any <br />drainage district benefitting the subdivision. <br />5. Sidewalks. The Subdivider shall maintain all public sidewalks required by <br />the City of Grand Island. <br />6. Electric. The Subdivider agrees to install all conduit, both primary and <br />secondary, as well as all necessary transformer pads in the subdivision in accordance with plans and <br />specifications approved by the Utilities Department, and subject to the City's inspection. <br />7. Landscaping. The Subdivider agrees to comply with the requirements of the <br />Landscaping Regulations of the City of Grand Island, and plans as approved with the issuance of a <br />building permit. <br />8. Care and Maintenance. Subdivider acknowledges and understands that at all <br />times during the development process and at all times thereafter the property must be maintained in <br />compliance with City Code including insuring that no grass, weeds, or worthless vegetation <br />accumulates and that the property remains free and clear of any prohibited garbage, waste, rubbish or <br />construction debris except for construction materials as allowed by law. Subdivider will ensure all <br />contractors, subcontractors, current and subsequent owners, or successors and assigns are notified of <br />their obligations to maintain the property as required by City Code. <br />9. Traffic Study. Prior to any additional development on the site the Subdivider <br />shall submit the proposed use and a preliminary plan and layout to the City Engineer to determine if <br />a traffic study is required for any changes to the proposed use of the property. The Subdivider shall <br />also submit turning movements schematics for review showing the vehicle paths for vehicles <br />entering and exiting the property. The Subdivider shall be responsible for the costs of these <br />materials and shall accept the results and recommendations and be responsible for necessary <br />improvements to North Front Street, Walnut Street and/or Pine Street as needed to accommodate the <br />proposed use. Subdivider understands that no additional permits or approvals shall be granted by the <br />City of Grand Island until completion of these obligations. <br />3 <br />
