The Affiant are the Successor Trustee under the terms and conditions of the James F. Hehnke Revocable Living Trust Agreement dated January 26th, 2012. 2. On February 28th, 2024 the Dorris Hehnke, wife of James F. Hehnke became the Successor Trustee of the said Trust following the death of James F. Hehnke on February 28th, 2024, the grantor and initial trustee of the said Trust. A copy of James F. Hehnke's death certificate is attached as Exhibit "A." 3. Dorris Hehnke is unable to act and serve as Successor Trustee of the James F. Hehnke Trust due to incapacity. The Affiants state and swear that they were named as Successor Co -Trustees of the James F. Hehnke Revocable Living Trust dated January 26th, 2012 in the event of Dorris Hehnke's incapacitation. A copy of the Acceptance to Act as Successor Co -Trustees under the James F. Henke Revocable Living Trust Agreement, is attached as Exhibit "B". The legal Description of the property is attached as Exhibit "C" 4. That the Affiants remain the Successor Co -Trustees of the said Trust as of this date. 5. That the James F. Hehnke Revocable Living Trust Agreement is in good standing and remains active and in full force at the time of this signing. 6. That pursuant to the terms of the said Trust and §30-3881 and §30-3882 of the Nebraska Uniform Trust Code, the Successor Trustee of said Trust has the power, without court authorization, to pay expenses and make distribution pursuant to the Trust. 7. The Affiants state that the James F. Hehnke Revocable Living Trust was amended on October 20th, 2023, however, the terms of said Trust did not affect the successor Trustee clause found in the Original Trust dated on January 26th, 2012.
