WDLD <br />REGISTER OF DEEDS <br />GAS SITE & ACCESS EASEMENT <br />KNOW ALL MEN BY THESE PRESENTS: <br />That The Blattner Family Trust, the "Grantor", of Hall County, Nebraska, for and in consideration of the <br />sum of Seventeen Thousand Dollars ($17,000) and other good and valuable consideration, the receipt of which is <br />hereby acknowledged, does hereby grant, remise, convey and relinquish unto NorthWestern Energy Public <br />Service Corporation, a South Dakota corporation, dlbla NorthWestern Energy, the "Grantee", with its principal <br />operations office located at 600 Market Street West, Huron, South Dakota 57350, its successors or assigns, an <br />exclusive gas site easement for aboveground equipment and improvements along with underground pipelines and <br />appurtenances, and a non-exclusive ingress and egress easement for access to said gas site, all for the installation, <br />maintenance and operation of a natural gas regulator station along with all appurtenances thereto over, under, upon <br />and through the following described real estate in the County of Hall, State of Nebraska, to -wit: <br />Legal Description — Gas Site Easement <br />A tract of land located in part of the Southwest Quarter of the Southeast Quarter (SW1/4 SE1/4) <br />of Section Five (5), Township Ten North (T10N), Range Nine West (R9W) of the 6th Principal <br />Meridian, Hall County, Nebraska, and more particularly described as follows: <br />Commencing at the South Quarter (S114) corner of Section 5; thence on an assumed bearing <br />of South 88°12'54" East, along the South line of the SW1/4 SE1/4 of Section 5, a distance of <br />271.85 feet; thence North 01°47'06" East, a distance of 80 feet to a point on the North line of <br />a 47 -foot -wide utility easement as recorded in Instrument No. 0201104809 at the Hall County <br />Register of Deeds and also being the Point of Beginning; thence continuing North 01°47'06" <br />East, a distance of 60.00 feet to a point on the Southwesterly tine of a 25 -foot -wide easement <br />as recorded in Document No. 78-007701 at the Hall County Register of Deeds and also being <br />a point of curvature; thence around a curve in a counterclockwise direction, along said <br />Southwesterly easement line, having a delta (A) angle of 05°34'07", a radius of 1005.37 feet, <br />an arc length of 97.71 feet, a chord bearing of South 50°18'57" East and a chord distance of <br />97.68 feet; thence North 88°12'54" West, a distance of 77.08 feet to the Point of Beginning; as <br />illustrated in Exhibit "A" attached hereto.
