DocuSign Envelope ID: E1A0E30C-7C28-45F5-8C00-3FE5E3A80950 <br />202401002 <br />STATE OF NEBRASKA DEPARTMENT OF ECONOMIC DEVELOPMENT <br />NEBRASKA AFFORDABLE HOUSING TRUST FUND PROGRAM <br />(Regarding Rental Housing Project: City of Wood River <br />Rental Conversion) <br />CONTRACT NO. 23-TFRH-34010 <br />This contract is entered into between the State of Nebraska Department of Economic <br />Development ("Department") and the City of Wood River, a Unit of Local Government, 108 West <br />10th Street, PO Box 8, Wood River, Nebraska 68883 ("Recipient"), upon the date of signature <br />by both parties. <br />RECITALS: <br />A. Pursuant to the Nebraska Affordable Housing Act ("Act"), the Department is directed to <br />administer the Nebraska Affordable Housing Trust Fund ("Trust Fund") and make the funds <br />("Trust Funds") on deposit therein available to qualified recipients. <br />B. The Department has been designated and empowered to receive, administer, and <br />disburse Trust Funds to achieve an adequate supply of affordable housing for <br />low -to -moderate income Nebraskans. The Department's and the Recipient's use of Trust <br />Funds is governed by the Act; the Rules and Regulations Concerning the Administration of <br />the Affordable Housing Act, Title 86, Nebraska Administrative Code, Chapter 5 ("Rules"); and <br />the Nebraska Affordable Housing Trust Fund Application Guidelines ("Guidelines") published <br />by the Department. The Act, Rules, and Guidelines are incorporated herein by this reference <br />(collectively referred to as the "Program"). <br />C. The Recipient has submitted an application ("Application") to the Department setting forth a <br />project to provide affordable housing units for low -to -moderate income Nebraskans using Trust <br />Funds. The Application has been approved and is incorporated herein by this reference. The <br />project consists of the conversion of a commercial property to rental housing units located, in <br />the City of Wood River, Nebraska (the "Project"). The units and the project requirements are <br />further described in the Application and in the Table of Project Requirements found on the next <br />page of this contract. <br />• The Project, will be located at 108 East 9th Street in the City of Wood River, <br />Nebraska with the following legal description: <br />The East One Half (E112) of Lot Eight (8), and all of Lot Nine (9), Block <br />Twenty -One (21), Original Town of Wood River, Hall County, Nebraska; <br />AND <br />Lot Ten (10) and the West Fourteen Inches (W14") of Lot Eleven (11), <br />Block Twenty -One (21), Original Town of Wood River, Hall County, <br />Nebraska. <br />• Of the three (03) total units in the Project, all three (03) will be designated as <br />Trust Fund -assisted units.
