DocuSign Envelope ID: E1A0E30C-7C28-45F5-8C00-3FE5E3A80950 <br />202401002 <br />§4.19 Authorization of Project Publicity and Information Sharing. <br />Prior to announcing or referring to the Project or Project activities in news releases, press <br />conferences, or other media, the Recipient must inform the Department and, if requested, <br />include an acknowledgement or reference to the funding made available for the Project under <br />this contract. <br />The Recipient agrees to allow the Department to issue news releases and otherwise share <br />information and/or make announcements about the Project. The Department is not required <br />to obtain any approval, written or otherwise, from the Recipient prior to releasing information <br />about the Project. <br />§4.20 Requirement to Provide Project Photographs. <br />The Recipient agrees to provide the Department with before and after photographs of the Project <br />whenever possible and agrees to obtain written consent from the owners and/or tenants when <br />applicable and necessary. <br />§4.21 Entire Agreement; Binding Effect; Counterparts; Governing Law. <br />This contract and any attachments, the approved Project application, and those items <br />incorporated by reference or statutes, or regulations, referenced herein contain the entire <br />agreement between the parties. Any statements, inducements, or promises not contained <br />therein are not binding upon the parties. <br />This agreement will be binding upon and will inure to the benefit of the successors, assigns, <br />and legal representatives of the parties. <br />This agreement and any amendment of this agreement may be signed in any number of <br />counterparts; each of which will be considered an original, and all of which taken together will <br />constitute one agreement or amendment, as the case may be. <br />This agreement shall be governed by, construed according to the laws and regulations of, and <br />subject to the jurisdiction of the State of Nebraska. <br />PART V: SPECIAL REQUIREMENTS AND ASSURANCES. <br />Per relevant federal/state statutes and the Guidelines, the Recipient acknowledges it may not <br />discriminate in its operation or in Project activities on the basis of age, religion, sex, race, color, <br />national origin, disability, or familial status. <br />The Recipient further agrees to comply with all provisions of the Americans with Disabilities <br />Act (ADA) with respect to hiring, training, and employment practices including reasonable <br />accommodation of persons with disabilities in hiring, training, and employment practices and <br />in assuring access by persons with disabilities to facilities and services provided by the <br />Recipient to the general public. <br />NAHTF 23-TFRH-34010—Page 16 of 18 <br />
