Construction contractors are expected to meet all applicable requirements of the <br />Nebraska Contractor Registration Act and provide a current, valid certificate of registration to <br />the Recipient for Recipient's records. <br />Upon request, the Recipient must submit copies of written agreements executed between the <br />Recipient and any subrecipients or contractors relating to the Project. <br />§4.13 State Liability Non-Liability/Hold Harmless. <br />The Recipient will hold the State of Nebraska and the Department harmless from any and all <br />claims, demands, and actions based upon or arising out of any services performed by the <br />Recipient or its associates, employees, contractors, or subcontractors under this contract. <br />§4.14 Verification of Work Eligibility Status for New Employees. <br />The Recipient is required and hereby agrees to use a federal immigration verification system <br />to determine the work eligibility status of new employees of the Recipient organization <br />physically performing services within the State of Nebraska. <br />In this context, "new employees" means employees hired on or after the effective date of this <br />contract. A "federal immigration verification system" means the electronic verification of the <br />work authorization program authorized by the Illegal Immigration Reform and Immigrant <br />Responsibility Act of 1996 (8 U.S.C. 1324a), known as the E -Verify Program, or an equivalent <br />federal program designated by the United States Department of Homeland Security or other <br />federal agency authorized to verify the work eligibility status of a newly hired employee. <br />This contractual obligation to verify work eligibility status for new employees physically <br />performing services within the State of Nebraska also applies to any and all subcontractors <br />utilized by the Recipient in performing this contract. The Recipient will be responsible to the <br />Department for enforcing this requirement with its subcontractors. <br />A failure by the Recipient to adhere to these requirements violates the statutory requirements <br />in Neb. Rev. Stat. §4-114 and, as such, will be deemed a substantial breach of this contract <br />which could result in the Department declaring Recipient to be in default on the contract. <br />§4.15 Verification of Lawful Presence for Public Benefits Eligibility. <br />The Department of Economic Development is prohibited by state law (Neb. Rev. Stat. §4-108) <br />from providing public benefits to a person not lawfully present in the United States. Public <br />benefits are statutorily defined broadly (see Neb. Rev Stat. §4-109); however, some <br />exemptions from the verification of lawful presence requirement are set forth in Neb. Rev Stat. <br />§4-110. <br />For the purposes of this contract, the Department has determined that, in the performance of <br />its contractual duties, the Recipient is providing public benefits to individuals or households <br />NAHTF 23-TFRH-34010—Page 14 of 18 <br />
