DocuSign Envelope ID: El AOE30C-7C28-45F5-8C00-3FE5E3A80950 <br />202401002 <br />Within ninety (90) days following completion of the Project and final disbursement of the Trust <br />Funds, the Recipient shall provide to the Department, in a format as prescribed, a Rental <br />Beneficiary Per Unit Report for each completed unit (market rate and NAHTF-assisted), a Final <br />Financial Report, and documentation of completion of Fair Housing action as prescribed during <br />Special Conditions (see Part I1 of this contract). <br />Other reports may be required prior to receiving a Certificate of Completion and may include <br />but are not limited to Certification of Compliance with Nebraska Department of Environment & <br />Energy (applies to new construction only). <br />§4.07 Conflict of Interest. <br />No officer, employee, or agent of the Recipient will participate in the selection, or the award or <br />administration of a contract supported by Trust Funds if a conflict of interest, real or perceived, <br />would be involved. Such a conflict would arise when the officer, employee, or agent; any <br />member of the immediate family of the officer, employee, or agent; any partner of the officer, <br />employee, or agent; or any organization which employs or is about to employ any of the above <br />has a financial or other interest in the firm selected for award. <br />The Recipient's officers, employees, or agents will neither solicit nor accept gratuities, favors, <br />or anything of monetary value from contractors, potential contractors, or parties to sub - <br />agreements during office tenure or for one year after the closeout of the Project. This stipulation <br />must be included in all other contracts and subcontracts related to the Project. <br />In the event a prohibited conflict of interest arises, the Recipient must inform the Department. <br />Upon written request, exceptions may be granted by the Department on a case-by-case basis <br />when it is determined that such an exception will serve to further the purposes of the Program. <br />§4.08 Early Termination. <br />The Department may terminate this contract for any reason upon sixty (60) days written notice <br />to Recipient. <br />This contract may also be terminated, in whole or in part, prior to the completion of the Project <br />when both parties agree that continuation is not feasible or would not produce beneficial results <br />commensurate with the further expenditure of funds. <br />In the event of mutual termination, the parties must agree on the termination conditions, <br />including effective date and the portion to be terminated. The Recipient may not incur new <br />obligations for the terminated portion after the effective date and must cancel as many <br />outstanding obligations as possible. If a release of funds has been achieved, the Department <br />will make funds available to the Recipient to pay for allowable expenses incurred before the <br />effective date of termination. <br />NAHTF 23-TFRH-34010—Page 12 of 18 <br />
