EASEMENT GRANT VVI .LUM31aU <br />202400648 <br />WHEREAS, First Party, RICHARD L. ALDERSON, a single person, <br />and Second Parties, CLIFFORD R. ALDERSON and BERNICE M. ALDERSON, <br />husband and wife, are the owners of adjoining property with a <br />common boundary line which constitutes the south property line <br />of First Party and the north property line of Second Parties, and <br />WHEREAS, there are presently trees, shrubs and vegetation <br />situated on the south portion of First Party's property, which <br />both parties desire that Second Parties have the use and enjoy- <br />ment of and which trees and shrubs provide a shelterbelt for <br />Second Parties' property; <br />NOW, THEREFORE, in consideration of TEN DOLLARS ($10.00) AND <br />OTHER VALUABLE CONSIDERATION, receipt of which is hereby acknow- <br />ledged, First Party hereby gives and grants to Second Parties, <br />their heirs, devisees, successors and assigns, a permanent ease- <br />ment for the purpose of keeping, maintaining, caring for and <br />replacing trees, shrubs, and other vegetation now located on or <br />later placed on the following described property: <br />A tract of land situated in. the South Half of the <br />Southeast Quarter (S'SE;) of Section Twenty -Three <br />(23), Township Eleven (11) North, Range Nine (9) <br />West of the 6th P.M., Hall County, Nebraska, more <br />particularly described as follows: <br />Beginning at a point which is one thousand <br />(1000) feet south of the northeast corner of the <br />South Half of the Southeast Quarter, being the <br />point of beginning, thence running southerly along <br />and upon the east line of the South Half of the <br />Southeast Quarter a distance of sixty (60) feet; <br />thence running westerly and parallel to the north <br />line of the South Half of the Southeast Quarter a <br />distance of four hundred thirty-five and six hun- <br />dredths (435.6) feet; thence running northerly and <br />parallel to the east line of the South Half of the <br />Southeast Quarter a distance of sixty (60) feet; <br />thence running easterly and parallel to the north <br />line of the South Half of the Southeast Quarter a <br />distance of four hundred thirty-five and six hun- <br />dredths (435.6) feet to the point of beginning, <br />containing .60 acres, more or less, <br />the easement granted herein being appurtenant to and running with <br />the real property owned by the Second Parties as the same adjoins <br />the lands of the First Party, and upon the express condition that <br />Second Parties shall maintain the trees, shrubs and other vege- <br />tation on the above described property at all times, and will not <br />at any time hereafter construct any building, structure, or improve- <br />ment on the above described property or make any use of the property <br />above described other than the present use. <br />IN WITNESS WHEREOF, is Bement Grant has been executed <br />this // day of / asement <br />, 1988, at Grand Island, <br />Hall County, Nebraska. <br />STATE OF NEBRASKA ) <br />ss. <br />COUNTY OF HALL <br />/ r <br />ARD ALIE'SO - First Party <br />"Grantor" <br />The f egoi}Ig instrument was acknowledged before me this // <br />day of <br />single person F '.rty, Grantor. <br />, 1988, by RICHARD L.
