The Trustor is Top Hat <br />Properties, LLC, A Nebraska Limited Liability Company, (hereinafter "Trustor"), and Thomas A. <br />Ziller, a single person, individually, (hereinafter "Borrower"). The Trustee is Denise D. Myers, of <br />Myers Law Office, 415 S. High St., PO Box 505, Cairo, Nebraska 68824, ("Trustee'). The <br />beneficiary is Keith A. Kelley, (Hereinafter, "Lender"). Borrower owes Lender the principal sum <br />of Two Hundred Forty Five Thousand Two Hundred Ninety Three and 41/100 Dollars <br />($245,293.41). This debt is evidenced by Borrower's note dated the same date as this Security <br />Instrument ("Note"), which provides for payment of principal, plus accrued interest in momthly <br />payments. The Deed of Trust (sometimes referred to herein as "security instrument") secures to <br />Lender: (a) the repayment of the debt evidenced by the Note, and all renewals, extensions and <br />modifications; (b) the payment of all other sums advanced under paragraph 4 to protect the <br />security of this Security Instrument; and (c) the performance of Borrower's covenants and <br />agreements.
