<br />GAS UTILITY EASEMENT
<br />KNOW ALL MEN BY THESE PRESENTS:
<br />That Steven D. Hostler, a widower, the "Grantor", of Hall County, Nebraska, for and in consideration of the
<br />sum of one dollar ($1.00) and other good and valuable consideration, the receipt of which is hereby acknowledged,
<br />does hereby grant, remise, convey and relinquish unto NorthWestern Energy Public Service Corporation, a
<br />South Dakota corporation, d/b/a NorthWestern Energy, the "Grantee", with its principal operations office located
<br />at 600 Market Street West, Huron, South Dakota 57350, its successors or assigns, a gas utility easement for the
<br />installation, maintenance and operation of an underground natural gas pipeline along with all appurtenances thereto
<br />over, under, upon and through the following described real estate in the County of Hall, State of Nebraska, to -wit:
<br />A 10 -foot -wide tract of land located in part of the Northeast Quarter (NE114) of Section Thirty-
<br />four (34), Township Eleven North (T11N), Range Ten West (R10W) of the 6th Principal
<br />Meridian, Hall County, Nebraska, as described in Joint Tenancy Warranty Deed recorded as
<br />Document No. 89-101782, except a tract of land described in Quit Claim Deed recorded in
<br />Book 150 of Deeds on Page 425, and except NWE South Subdivision, an Addition to the City
<br />of Grand Island, in part of the Northeast Quarter of the Northeast Quarter (NE1/4 NE1/4) of
<br />Section 24, T11N, R10W of the 6th P.M., Hall County, Nebraska, and more particularly
<br />described as follows:
<br />Commencing at the East Quarter (E114) corner of Section 34; thence on an assumed bearing
<br />of South 89°22'35" West, along the South line of the Northeast Quarter (NE1/4) of said Section
<br />34, a distance of 40.00 feet to the Point of Beginning; thence continuing South 89°22'35" West,
<br />along said South line, a distance of 10.00 feet; thence North 00°39'31" East, parallel to the
<br />East line of said NE1/4, a distance of 2542.75 feet to a point on the South line of NWE South
<br />Subdivision; thence South 89°51'41" East, along said South line of NWE South Subdivision,
<br />a distance of 10.00 feet; thence South 00°39'31" West, parallel to said East line of the NE114,
<br />a distance of 2542.61 feet to the Point of Beginning; as illustrated in Exhibit "A" attached
<br />hereto. Said tract of land containing 0.584 acres, more or less.
<br />[The purpose of the above described easement is for an underground natural gas pipeline
<br />along with all appurtenances thereto (the "Facilities").]
