Stelk, a single person, the "Grantor", of Hall County, Nebraska, for and in consideration of <br />the sum of one dollar ($1.00) and other good and valuable consideration, the receipt of which is hereby <br />acknowledged, does hereby grant, remise, convey and relinquish unto NorthWestern Energy Public Service <br />Corporation, a South Dakota corporation, d/b/a NorthWestern Energy, the "Grantee", with its principal <br />operations office located at 600 Market Street West, Huron, South Dakota 57350, its successors or assigns, a gas <br />utility easement for the installation, maintenance and operation of an underground natural gas pipeline along with all <br />appurtenances thereto over, under, upon and through the following described real estate in the County of Hall, State <br />of Nebraska, to -wit: <br />A 10 -foot -wide tract of land located in part of the East Half of the Southeast Quarter (E1/2 <br />SE114) of Section Thirty-four (34), Township Eleven North (T11 N), Range Ten West (R10W) of <br />the 6th Principal Meridian, Hall County, Nebraska, except Lot One (1), Pierce Subdivision <br />located in part of the East Half of the Southeast Quarter (E112 SE1/4) of Section 34, T11N, <br />R10W of the 6th P.M., Hall County, Nebraska, and more particularly described as follows: <br />Commencing at the East Quarter (E114) corner of Section 34; thence on an assumed bearing <br />of South 89°22'35" West, along the North line of the Southeast Quarter (SE114) of said Section <br />34, a distance of 40.00 feet to the Point of Beginning; thence South 01°12'15" West, parallel <br />to the East line of said SE114, a distance of 2308.08 feet to a point on the North line of Piece <br />Subdivision; thence North 89°49'09" West, along said North line of Pierce Subdivision, a <br />distance of 10.00 feet; thence North 01°12'15" East, parallel to said East line of the SE114, a <br />distance of 2307.94 feet to said North line of the SE1/4; thence South 89°22'35" East, along <br />said North line of the SE114, a distance of 10.00 feet to the Point of Beginning; as illustrated <br />in Exhibit "A" attached hereto.
