Bockmann, a single person, an undivided one-half (1/2) interest, and Jay D. Bockmann and <br />Stephanie A. Bockmann, husband and wife, an undivided one-half (1/2) interest, together as the "Grantor", all of <br />Hall County, Nebraska, for and in consideration of the sum of one dollar ($1.00) and other good and valuable <br />consideration, the receipt of which is hereby acknowledged, do hereby grant, remise, convey and relinquish unto <br />NorthWestern Energy Public Service Corporation, a South Dakota corporation, d/b/a NorthWestern Energy, <br />the "Grantee", with its principal operations office located at 600 Market Street West, Huron, South Dakota 57350, its <br />successors or assigns, a gas utility easement for the installation, maintenance and operation of an underground <br />natural gas pipeline along with all appurtenances thereto over, under, upon and through the following described real <br />estate in the County of Hall, State of Nebraska, to -wit: <br />A 10 -foot -wide tract of land located in part of Lot One (1), Pierce Subdivision in the East Half <br />of the Southeast Quarter (E112 SE1/4) of Thirty-four (34), Township Eleven North (T11N), <br />Range Ten West (R10W) of the 6th Principal Meridian, Hall County, Nebraska, and more <br />particularly described as follows: <br />Commencing at the Southeast (SE) of Lot 1, Pierce Subdivision, and also being the <br />intersection of the West right-of-way line of Engleman Road and the North right-of-way line <br />of Schimmer Drive; thence on an assumed bearing of North 89°48'57" West, along the South <br />line of said Lot 1 and the North right-of-way line of Schimmer Drive, a distance of 10.00 feet; <br />thence North 01°12'15" East, parallel to the East line of the SE114 of Section 34, a distance of <br />408.05 feet to a point on the North line of said Lot 1; thence South 89°49'09" East, along said <br />North line of Lot 1, a distance of 10.00 feet to a point on the West right-of-way line of Engleman <br />Road; thence South 01°12'15" West, along the East line of said Lot 1 and said West right-of- <br />way line of Engleman Road, a distance of 408.05 feet to the Point of Beginning; as illustrated <br />in Exhibit "A" attached hereto. Said tract of land containing 0.094 acres, more or less. <br />[The purpose of the above described easement is for an underground natural gas pipeline <br />along with all appurtenances thereto (the "Facilities").] <br />
