Zwink and Darlene A. Zwink, husband and wife, as joint tenants with rights of <br />survivorship and not as tenants in common, the "Grantor", of Hall County, Nebraska, for and in consideration of <br />the sum of one dollar ($1.00) and other good and valuable consideration, the receipt of which is hereby <br />acknowledged, do hereby grant, remise, convey and relinquish unto NorthWestern Energy Public Service <br />Corporation, a South Dakota corporation, d/b/a NorthWestern Energy, the "Grantee", with its principal <br />operations office located at 600 Market Street West, Huron, South Dakota 57350, its successors or assigns, a gas <br />utility easement for the installation, maintenance and operation of an underground natural gas pipeline along with all <br />appurtenances thereto over, under, upon and through the following described real estate in the County of Hall, State <br />of Nebraska, to -wit: <br />A 10 -foot -wide tract of land located in part of the West Half of the Southwest Quarter of the <br />Southwest Quarter (W1/2 SW1/4 SW1/4) of Section Thirty-five (35), Township Eleven North <br />(T11 N), Range Ten West (R10W) of the 6th Principal Meridian, Hall County, Nebraska, and <br />more particularly described as follows: <br />Commencing at the Southwest (SW) corner of Section 35; thence on an assumed bearing of <br />North 01°12'15" East, along the West line of the Southwest Quarter (SW1/4) of Section 35, a <br />distance of 40.00 feet; thence North 89°5971" East, a distance of 33.00 feet to the East county <br />road right-of-way line of Engleman Road and also being the Point of Beginning; thence North <br />01°12'15" East, along said East right-of-way line, a distance of 10.00 feet; thence North <br />89°59'21" East, parallel to the South line of said W1/2 SW1/4 SW1/4, a distance of 627.66 feet <br />to the East line of said W1/2 SW1/4 SW1/4; thence South 01°09'38" West, along the said East <br />line of said W1/2 SW114 SW1/4, a distance of 10.00 feet; thence North 89°59'21" West, parallel <br />to said South line of the W112 SW1/4 SW1/4, a distance of 627.67 feet; thence North 01°12'15" <br />East, parallel to said West line of the SW114 and said East county road right-of-way line of <br />Engleman Road, a distance of 10.00 feet to the Point of Beginning; as illustrated in Exhibit <br />"A" attached hereto.
