Schimmer and Cynthia E. Schimmer, husband and wife, the "Grantor", of Hall County, Nebraska, for and in consideration of the sum of one dollar ($1.00) and other good and valuable consideration, the receipt of which is hereby acknowledged, do hereby grant, remise, convey and relinquish unto NorthWestern Energy Public Service Corporation, a South Dakota corporation, d/b/a NorthWestern Energy, the "Grantee", with its principal operations office located at 600 Market Street West, Huron, South Dakota 57350, its successors or assigns, a gas utility easement for the installation, maintenance and operation of an underground natural gas pipeline along with all appurtenances thereto over, under, upon and through the following described real estate in the County of Hall, State of Nebraska, to -wit: A 10 -foot -wide tract of land located in part of the East Half of the Southwest Quarter (E1/2 SW1/4) and the West Half of the Southeast Quarter (W112 SE1/4) of Section Thirty-five (35), Township Eleven North (T11N), Range Ten West (R10W) of the 6th Principal Meridian, Hall County, Nebraska, except one acre thereof as described in Deed of Distribution recorded as Document No. 200800255, and more particularly described as follows: Commencing at the Southwest (SW) corner of the E1/2 SW114 of Section 35; thence on an assumed bearing of North 01°07'07" East, along the West line of said E112 SW1/4, a distance of 40.00 feet to the Point of Beginning; thence continuing North 01°07'07" East, along said West line of the E112 SW1/4, a distance of 10.00 feet; thence North 89°59'47" East, parallel to the South line of said E1/2 SW1/4, a distance of 1320.53 feet; thence North 89°58'25" East, parallel to the South line of the W112 SE114 of Section 35, a distance of 1190.57 feet to the West line of a tract of land as described in Warranty Deed recorded as Instrument No. 202104122; thence South 01°24'12" West, along said West tract line, a distance of 10.00 feet; thence South 89°58'25" West, parallel to said South line of the W1/2 SE1/4, a distance of 1190.32 feet; thence South 89°59'47" West, parallel to said South line of the E1/2 SW1/4, a distance of 1320.73 feet to the Point of Beginning; as illustrated in Exhibit "A" attached hereto. Said tract of land containing 0.576 acres, more or less. [The purpose of the above described easement is for an underground natural gas pipeline along with all appurtenances thereto (the "Facilities").]
