Schimmer and Cynthia E. Schimmer, husband and wife, the "Grantor", of Hall County, <br />Nebraska, for and in consideration of the sum of one dollar ($1.00) and other good and valuable consideration, the <br />receipt of which is hereby acknowledged, do hereby grant, remise, convey and relinquish unto NorthWestern <br />Energy Public Service Corporation, a South Dakota corporation, d/b/a NorthWestern Energy, the "Grantee", <br />with its principal operations office located at 600 Market Street West, Huron, South Dakota 57350, its successors or <br />assigns, a gas utility easement for the installation, maintenance and operation of an underground natural gas pipeline <br />along with all appurtenances thereto over, under, upon and through the following described real estate in the County <br />of Hall, State of Nebraska, to -wit: <br />A 10 -foot -wide tract of land located in part of the East Half of the Southwest Quarter (E1/2 <br />SW1/4) and the West Half of the Southeast Quarter (W112 SE1/4) of Section Thirty-five (35), <br />Township Eleven North (T11N), Range Ten West (R10W) of the 6th Principal Meridian, Hall <br />County, Nebraska, except one acre thereof as described in Deed of Distribution recorded as <br />Document No. 200800255, and more particularly described as follows: <br />Commencing at the Southwest (SW) corner of the E1/2 SW114 of Section 35; thence on an <br />assumed bearing of North 01°07'07" East, along the West line of said E112 SW1/4, a distance <br />of 40.00 feet to the Point of Beginning; thence continuing North 01°07'07" East, along said <br />West line of the E112 SW1/4, a distance of 10.00 feet; thence North 89°59'47" East, parallel to <br />the South line of said E1/2 SW1/4, a distance of 1320.53 feet; thence North 89°58'25" East, <br />parallel to the South line of the W112 SE114 of Section 35, a distance of 1190.57 feet to the <br />West line of a tract of land as described in Warranty Deed recorded as Instrument No. <br />202104122; thence South 01°24'12" West, along said West tract line, a distance of 10.00 feet; <br />thence South 89°58'25" West, parallel to said South line of the W1/2 SE1/4, a distance of <br />1190.32 feet; thence South 89°59'47" West, parallel to said South line of the E1/2 SW1/4, a <br />distance of 1320.73 feet to the Point of Beginning; as illustrated in Exhibit "A" attached <br />hereto.
