Moser, a single person, the "Grantor', of Hall County, Nebraska, for and in consideration of the sum of one dollar ($1.00) and other good and valuable consideration, the receipt of which is hereby acknowledged, does hereby grant, remise, convey and relinquish unto NorthWestern Energy Public Service Corporation, a South Dakota corporation, d/b/a NorthWestern Energy, the "Grantee", with its principal operations office located at 600 Market Street West, Huron, South Dakota 57350, its successors or assigns, a gas utility easement for the installation, maintenance and operation of an underground natural gas pipeline along with all appurtenances thereto over, under, upon and through the following described real estate in the County of Hall, State of Nebraska, to -wit: A 10 -foot -wide tract of land located in part of the Southwest Quarter of the Southeast Quarter (SW114 SE1/4) of Section Thirty-five (35), Township Eleven North (T11N), Range Ten West (R10W) of the 6th Principal Meridian, Hall County, Nebraska, as described in Warranty Deed recorded as Document No. 202104122, and more particularly described as follows: Commencing at the South Quarter (S1/4) corner of Section 35; thence on an assumed bearing of North 89°58'25" East, along the South line of the SE1/4 of said Section 35, a distance of 1321.38 feet to the Southeast (SE) corner of a tract of land as described in Warranty Deed recorded as Instrument No. 202104122; thence North 01°24'12" East, along the East line of said tract of land, a distance of 40.00 feet to the Point of Beginning; thence South 89°58'25" West, parallel to the South line of the W1/2 SE1/4, a distance of 132.04 feet to the West line of said tract of land; thence North 01°24'12" East, along said West line of said tract of land, a distance of 10.00 feet; thence North 89°58'25" East, parallel to the South line of the W1/2 SE1/4, a distance of 132.04 feet to the East line of said tract of land; thence South 01°24'12" West, along the East line of said tract of land, a distance of 10.00 feet to the Point of Beginning; as illustrated in Exhibit "A" attached hereto. Said tract of land containing 0.030 acres, more or less.
