Moser, a single person, the "Grantor', of Hall County, Nebraska, for and in consideration of <br />the sum of one dollar ($1.00) and other good and valuable consideration, the receipt of which is hereby <br />acknowledged, does hereby grant, remise, convey and relinquish unto NorthWestern Energy Public Service <br />Corporation, a South Dakota corporation, d/b/a NorthWestern Energy, the "Grantee", with its principal <br />operations office located at 600 Market Street West, Huron, South Dakota 57350, its successors or assigns, a gas <br />utility easement for the installation, maintenance and operation of an underground natural gas pipeline along with all <br />appurtenances thereto over, under, upon and through the following described real estate in the County of Hall, State <br />of Nebraska, to -wit: <br />A 10 -foot -wide tract of land located in part of the Southwest Quarter of the Southeast Quarter <br />(SW114 SE1/4) of Section Thirty-five (35), Township Eleven North (T11N), Range Ten West <br />(R10W) of the 6th Principal Meridian, Hall County, Nebraska, as described in Warranty Deed <br />recorded as Document No. 202104122, and more particularly described as follows: <br />Commencing at the South Quarter (S1/4) corner of Section 35; thence on an assumed bearing <br />of North 89°58'25" East, along the South line of the SE1/4 of said Section 35, a distance of <br />1321.38 feet to the Southeast (SE) corner of a tract of land as described in Warranty Deed <br />recorded as Instrument No. 202104122; thence North 01°24'12" East, along the East line of <br />said tract of land, a distance of 40.00 feet to the Point of Beginning; thence South 89°58'25" <br />West, parallel to the South line of the W1/2 SE1/4, a distance of 132.04 feet to the West line of <br />said tract of land; thence North 01°24'12" East, along said West line of said tract of land, a <br />distance of 10.00 feet; thence North 89°58'25" East, parallel to the South line of the W1/2 <br />SE1/4, a distance of 132.04 feet to the East line of said tract of land; thence South 01°24'12" <br />West, along the East line of said tract of land, a distance of 10.00 feet to the Point of <br />Beginning; as illustrated in Exhibit "A" attached hereto. Said tract of land containing 0.030 <br />acres, more or less. <br />[The purpose of the above described easement is for an underground natural gas pipeline <br />along with all appurtenances thereto (the "Facilities").] <br />
