Stelk, a single person, the "Grantor", of Hall County, Nebraska, for and in consideration of the sum of one dollar ($1.00) and other good and valuable consideration, the receipt of which is hereby acknowledged, does hereby grant, remise, convey and relinquish unto NorthWestern Energy Public Service Corporation, a South Dakota corporation, d/b/a NorthWestern Energy, the "Grantee", with its principal operations office located at 600 Market Street West, Huron, South Dakota 57350, its successors or assigns, a gas utility easement for the installation, maintenance and operation of an underground natural gas pipeline along with all appurtenances thereto over, under, upon and through the following described real estate in the County of Hall, State of Nebraska, to -wit: A 10 -foot -wide tract of land located in part of the South Half of the East Half of the East Half (S1/2 E112 E112) of Section Thirty-five (35), Township Eleven North (T11 N), Range Ten West (R10W) of the 6th Principal Meridian, Hall County, Nebraska, and more particularly described as follows: Commencing at the Southeast (SE) corner of Section 35; thence on an assumed bearing of South 89°58'25" West, along the South line of the SE114 of Section 35, a distance of 40.00 feet; thence North 01°46'08" East, a distance of 40.00 feet to the Point of Beginning; thence South 89°58'25" West, parallel to the South line of the E112 SE1/4, a distance of 1281.62 feet to the West line of the E112 SE114; thence North 01°24'12" East, along said West line, a distance of 10.00 feet; thence North 89°58'25" East, parallel with said South line of the E112 SE1/4, a distance of 1281.68 feet; thence South 01°46'08" West, a distance of 10.00 feet to the Point of Beginning; as illustrated in Exhibit "A" attached hereto.
