202400233 <br />Section 9. Vehicles. No trucks, trailers, boat, motor homes, campers, equipment or <br />machinery or cars not in daily use shall ever be parked, located or otherwise maintained on any Lot, <br />parking areas, street, or Common Area in the Properties, except in cases of emergency due to breakdown <br />or accident. <br />Section 10. Storage/Placement of Items. No garbage cans, wood piles, or clotheslines or <br />clothes hangers may be placed on any Lot constructed or used unless completely concealed from view <br />from any adjoining Lot and unless they are located only by the private patio approved by the Association. <br />Section 11. Garage Doors. Garage doors shall remain closed at all times except when being <br />used for movement of vehicles or other items in and out of such structure. <br />Section 12. Garbage Receptacles. Each owner agrees to place their garbage receptacles at <br />the curbside of their residence no sooner than the evening prior to the day that the garbage will be picked <br />up. <br />Section 13. Residence on Property. All Owners must reside in and occupy the home which <br />they own. <br />ARTICLE VII <br />INSURANCE <br />Section 1. Insurance. Since there are no common areas owned by the Association, the <br />Association shall not purchase insurance on the Properties. <br />Section 2. Additional Insurance. Each Lot owner shall be responsible for and may obtain <br />insurance, at his or her expense, for his or her own benefit insuring the improvements upon each Lot. <br />ARTICLE VIII <br />GENERAL PROVISION <br />Section 1. Enforcement. The Association or any Owner shall have the right to enforce by <br />any proceeding at law or in equity, all restrictions, conditions, covenants , reservations, liens and charges <br />now or hereafter imposed by .the provisions of this Declaration. Failure by the Association or by an <br />Owner to enforce any covenants or restrictions herein contained shall in no event be deemed a waiver of <br />the right to do so thereafter. <br />Section 2. Severability. Invalidation of any one of these covenants or restrictions by <br />judgment or Court order shall in no way affect any other provisions which shall remain in full force and <br />effect. <br />Section 3. Amendment. The covenants and restrictions of this Declaration shall run with <br />and bind the land for a term of twenty(20) years from the date this Declaration is recorded after which <br />time it shall be automatically extended for successive periods of ten (10) years. This Declaration may be <br />amended during the first twenty (20) years by an instrument signed by the Owners of not less than fifty- <br />one percent (51%) of the Lots. Any amendments must be recorded. <br />IN WITNESS WHEREOF, the undersigned, being the Declarant herein, has executed this <br />Declaration as of the /d day of January, 2024. <br />5 <br />
