DIANE BOCKMANN, Trustee of the K. Diane Bockmann Revocable Trust dated December 27, 2000; and K. DIANE BOCKMANN, Trustee of the Darryl D. Bockmann Revocable Trust dated December 27, 2000, and their successors or assigns, collectively "Grantor", for and in consideration of the amount of $1.00, receipt of which is hereby acknowledged, does hereby grant unto SOUTHERN PUBLIC POWER DISTRICT, a public corporation whose post office address is Grand Island, Nebraska, and to its successors or assigns, collectively "Grantee"; a non-exclusive easement and servitude for the purpose of access to overhead electric power line facilities owned by Grantee, over the following described property located in the County of Hall, State of Nebraska: The Northerly twenty-five (25) feet of that part of Lots Nine (9) and Ten (10) and all accretions thereto lying south of and adjacent to State Highway Right -of -Way and west of Lot Two (2), Highway Motels Subdivision, in Section Twenty -Four (24), Township Ten (10) North, Range Ten (10) West of the 6th P.M., Hall County, Nebraska, and as shown on attached Exhibit "A" incorporated herein by reference, containing 0.89 acres more or less. Grantee shall indemnify and hold Grantor harmless for all claims for injuries and damages caused by the use of said easement by Grantee. Grantor shall not hold Grantee responsible for any damages to Grantor's property caused by the use of said easement by Grantee. Grantee shall have the right to move or remove any structures, fences, or other objects located within the easement area that impede Grantee's access to or across said easement, with the exception of those facilities owned by the easement holders listed below. Grantor covenants that he is the owner of the above described lands and that the said lands are free and clear of encumbrances and liens of whatsoever character except those held by the following persons: City of Grand Island — Easement for Sanitary Sewer Line Great Plains Communications — Easement for Underground Cable It is further understood that, whenever necessary, words used in this instrument in the singular shall be construed to read in the plural and that words used in the masculine gender shall be construed to read in thee feminine.
